Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson and County Clerk, Rebecca Rossell. Johnson offered prayer. Henry called the meeting to order at 9:00 A.M. Commissioner Woodruff was absent.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 10, 2020. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

Motion by Weems, seconded by Johnson to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

Motion by Johnson, seconded by Weems to adopt Resolution No. 2020-09 appointing the county depositories for 2020. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

Motion by Hewgley, seconded by Johnson to receive and order filed the fee reports submitted by the Register of Deeds and County Sheriff. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Hewgley, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 10, 2020. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

Motion by Hewgley, seconded by Weems to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real estate. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

County Highway Supt., Carla O’Dell, informed the County Board about the bridge that was selected by the State of Nebraska located on O’Fallen Road as part of the Transportations Innovation Act. The bridge will be replaced with a triple culvert. The county road department will do the work. She was requesting direction on how they would like to proceed with the required engineering services as it did not require an RFP.

 

Commissioner Weems stated he would like to see multiple quotes.

 

Motion by Weems, seconded by Hewgley to authorize the Highway Supt. to investigate multiple informal bids for the O’Fallen Road bridge project. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

Deputy County Attorney, Joe Wright, gave an update on the ongoing Charter Communication Franchise Renewal agreement. The negotiations have been going on for several years. The default or forfeiture clause is where the parties cannot agree. The City of North Platte and the County of Scotts Bluff have reached agreements with Charter and he feels this would be a good template to use.

 

Motion by Hewgley, seconded by Weems to go into closed session at 9:35 A.M. concerning strategy session regarding negotiations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

 

Chairman Henry restated the motion for the closed session.

 

Motion by Johnson, seconded by Hewgley to go into open session at 9:56 A.M. Upon roll call vote Hewgley, Weems, Henry and Johnson voted “aye”. Nays, none. Woodruff absent.

Advance notice and the agenda for the February 18, 2020 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on February 14, 2020; and was also emailed to the media on February 14, 2020.

 

The agenda for the meetings to be held on Monday, February 24, 2020 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
