Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Johnson offered prayer. Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on April 27, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to receive and order filed the treasurer’s receipts. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley abstained due to a possible conflict of interest with one of the claims.
Motion by Weems, seconded by Woodruff to accept the resignation of Deb McCarthy from the Lincoln County HIPAA Steering Committee effective May 4, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to authorize the Chairman to sign the rental agreements for the Wallace American Legion Hall for the 2020 Elections. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.
COVID-19 update by Brandon Myers, Region 51 Emergency Management Director.
Motion by Woodruff, seconded by Hewgley to settle with Jeremy D. Hill in regards to the guardian ad litem fees due and owing (including costs & interest) to “The county of Lincoln” by Jeremy Hill, Case No. CI 99-135, in the District Court of Lincoln County, Nebraska, in the amount of $1,100.00, upon the cashier check clearing before May 18, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Public hearing was opened at 10:01 A.M. on the manager application of William J. Peers for Lake Maloney Golf Course Inc. located at 608 Birdie Lane, North Platte, NE. Lake Maloney Golf Course Inc. currently has a Class I Beer On-Sale Only Liquor License.
William Peers introduced himself and gave a brief work history.

Motion by Hewgley, seconded by Woodruff to approve the manager application of William J. Peers for Lake Maloney Golf Course Inc. located at 608 Birdie Lane, North Platte, NE. Lake Maloney Golf Course Inc. currently has a Class I Beer On-Sale Only Liquor License, License No. I – 097927. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Sheriff Kramer sent an email stating he had no objections to the liquor license applications submitted by Big Red Liquor for two upcoming events.
County Board asked applicant if they were still looking at the dates requested for the bull riding event of May 22 & May 23. She replied yes.
The County Sheriff would have to be called to enforce the DHM.
Commissioner Weems encouraged them to be within the CDC guidelines.
Motion by Johnson, seconded by Woodruff to approve and authorize the Chairman to sign a special designated liquor license submitted by Big Red Liquor for a bull riding event to be held on May 22 & 23, 2020 at North Platte Livestock Auction however it does not include the alternate date of August 15, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
No action was taken on the special designated liquor license submitted by Beg Rid Liquor for a wedding reception to be held on May 30, 2020 at the Lincoln County Fairgrounds at the applicant’s request. Application will be returned to the applicant along with the check if we have one for the license. Applicant will need to reapply.
Discussed additional fencing concerning the South River Road Reconstruction project requested by the land owner.
Brock Wurl, legal counsel and Chase Dodson, land manager appeared on behalf of the land owners. They reported that the fence had been partially removed. They would like the fence to be moved back to the north edge to keep trespassers out. The current fencing material could be re-used.
Commissioner Henry asked why it was on the county right of way.
Dodson replied that the fence pre-existed the road.
Commissioner Hewgley commented that according to the records the road had been there since the late 1890’s.
Commissioner Woodruff reported the only new material needed would be a new H Brace and he felt the county road consumed the fence.
Commissioner Hewgley said we would need to move the fence 10 feet to the north as long as the fence is on the proper right of way.
Commissioner Woodruff stated the utility pole might be on the right of way line.
O’Dell replied that utilities do normally set on the back of the county right of way but she would have to review.
Commissioner Weems stated his concern was that it be done correctly.
Motion by Johnson, seconded by Weems to approve the additional fencing with the use of all existing materials except an H-brace to be placed on the existing right of way.
Commissioner Hewgley clarified it will be on the north edge of the county right of way.
Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Presentation of construction plan and timeline by Carla O’Dell, Lincoln County Highway Supt., on the Cattle Growers Road Project. She reported that specs are ready to go. She is suggesting delivery to be completed in 180 days after the bid is accepted. This gives the Road Dept. time to get the base set and gives them some flexibility.
Commissioner Hewgley asked if the delivery bid rates were for several different dates.
Commissioner Henry expressed concern about losing what the county had done so far if there is no cap on it.
Brian Glos, Assistant Hwy Supt., replied that there is a gravel cap on it now and it should be stable.
Commissioner Woodruff questioned if they were planning on doing the whole project this summer.
Glos responded that they would like to get as far as they can, at least to the Garfield Table road.
O’Dell confirmed that the bid specs would be for delivery to two (2) different sites.
County Board directed the Highway Supt. to proceed with the plan as presented.

continually current and open for inspection at the office of the Lincoln County Clerk.
