Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Henry offered prayer. Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Hewgley, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 20, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to receive and order filed the Condition of the Treasury of Lincoln County, NE from January 1, 2020 to June 30, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to authorize the Chairman to sign the NE Commission on Law Enforcement and Criminal Justice Federal Grants & Programs Division Sub-Recipient Audit Acknowledgement Form for Victim Witness Grant #FY2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:17 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on July 20, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
Motion by Johnson, seconded by Woodruff to approve notice of valuation change numbered 2020-23 as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:23 A.M. and the Lincoln County Board of Commissioners reconvened.
Motion by Woodruff, seconded by Johnson to approve and authorize the Chairman to sign the special designated liquor application submitted by GL Concepts for a wedding reception at Harbor Lights on August 8, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Carla O’Dell, Lincoln County Highway Supt., had previously presented three options to the county board concerning Eugene Ave: 1) Installation of No Truck signs 2) Installation of weight restrictions signs or 3) closure of Eugene Ave at Buffalo. She sent a survey to 14 residences on Eugene Ave and 5 residences on Chokecherry. Six residents responded and is included in the report to the county board.
Commissioner Weems commented that he likes the option of signage for No Thru Trucks.
Todd Diedel, a resident of Eugene Ave., stated he has semi with a grain trailer and he needs to be able to park on Eugene. He does not go down Eugene, he always uses Buffalo.
Mike Koch, also a resident of Eugene Ave., reported he would like to see the road widened and improved.
Commissioner Weems replied that the county can’t fix the road right now so they are discussing short term mitigation. He likes signage of No Thru Trucks to minimize the traffic but not disenfranchise those living in the area.
Commissioner Hewgley commented that it would be prudent to work with the City of North Platte on what is drafted.
Commissioner Woodruff asked who would enforce a weight limit restriction.
Sheriff Kramer responded that the Sheriff’s Office enforce statutes. He suggested the County Board consider reducing the speed limit from 35 mph to 25 mph. They will be able to enforce the speed limit but they have no way to enforce the tonnage.
Commissioner Henry stated he would be in favor of lowering the speed limit and limiting it to local traffic.
Commissioner Weems recapped the discussion: 1) limit it to No Thru trucks with a weight restriction; 2) lower the speed limit and 3) work with the City of North Platte.
Highway Supt., legal counsel, and road committee members will meet with representatives of the City of North Platte and come back with a recommendation to the County Board.
County Assessor, Julie Stenger and Lead Appraiser, Charity Farley presented the Three Year Plan of Assessment update for Lincoln County 2020.
Motion by Hewgley, seconded by Woodruff to go into closed session at 10:25 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Henry restated the motion for the closed session.
Motion by Woodruff, seconded by Johnson to go into open session at 10:51 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Advance notice and the agenda for the July 27, 2020 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 25, 2020; and was also emailed to the media on July 25, 2020.
The agenda for the meetings to be held on Monday, August 3, 2020 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
