Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Woodruff offered prayer. Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Hewgley, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on September 8, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to receive and order filed the fee report submitted by the County Clerk. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign a rental contract with MIS for the Register of Deeds. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
County Assessor, Julie Stenger appeared.
Motion by Weems, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on September 8, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to approve and authorize the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Mr. Perez’s daughter did not appear at the meeting concerning the appeal for notice of rejection of homestead exemption. She did bring the requested tax information into the County Assessor’s office at 4:48 P.M. on September 11th.
County Assessor, Julie Stenger, reported that she had spoken with his daughter and had also contact the state concerning the appeal. The state indicated that the County Board of Equalization could do as they seen fit, but that the tax commissioner could deny the application since it was incomplete and missed the statutory deadlines.
Motion by Woodruff, seconded by Johnson to deny the appeal of Homestead Exemption rejection submitted by Ruben Perez. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
County Assessor, Julie Stenger, commented that she would contact his daughter and see if the medical form certification could be sent to the doctor for consideration.
The Lincoln County Board of Equalization recessed at 9:29 A.M. and the Lincoln County Board of Commissioners reconvened.
Lincoln County Planning Administrator, Judy Clark, appeared. The application for Wendeborn Administrative Subdivision is re-configure two lots and move the lot lines. Planning staff has no objection.
Motion by Weems, seconded by Woodruff to approve the application submitted by Alice Robinson and Anna Bellinger for Wendeborn Administrative Subdivision located at 5998 & 6084 South Range Road on property described as Tract F, Wendeborn’s Acreage Addition in Section 24, Township 13 North, Range 32 West of the 6th P.M., Lincoln County, NE. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Lincoln County Planning Administrator, Judy Clark, commented on the application for Swedberg 2nd Administrative Subdivision which is to split an existing home site off. Planning staff has no objection.
Motion by Weems, seconded by Woodruff to approve the application by Sheree Swedberg for Swedberg 2nd Administrative Subdivision located at 2899 North Lamont Road. The property is described as part of the SW ¼ of Section 24, Township 14 North, Range 30 West of the 6th P.M., Lincoln County, NE. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to approve the reappointment of Steve Koch and Zak Eickhoff to the Lincoln County Planning Commission for 3 year terms. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Hewgley to approve the appointment of Brent Roggow to the Lincoln County Planning Commission for a 3 year term. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Recess at 10:00 A.M. as the Lincoln County Board of Commissioners and reconvene as the Lincoln County Board of Equalization.
Motion by Weems, seconded by Hewgley into closed session at 10:00 A.M. concerning strategy session regarding pending litigations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Henry restated the motion for the closed session.

Adjourn as the Lincoln County Board of Equalization at 10:30 A.M. and reconvene as the Lincoln County Board of Commissioners.

Susan Maline, CPA, at McChesney Martin & Sagehorn presented the 2020-21 proposed budget for fiscal year 2020-2021 for Lincoln County.
She reported that the budget document presented at the hearing was different than the budget notice that was published. She had to add $1.6 million dollars in tax request and expenditures to the Jail Bond Fund for repayment of the 2020 series bonds for the jail addition and remodel project. This will allow for this year’s payment as well as future requirements for the bond payment in the next fiscal year to insure there will be adequate funds on hand.
Chairman Henry opened the public hearing at 11:22 A.M. to receive comments on the proposed 2020-2021 fiscal year Lincoln County, NE budget.
Eric Seacrest told board members that he appreciated their efforts on improving county roads and leaving the road equipment program intact.
No other comments were received.
The public hearing was closed at 11:28 A.M.
Motion by Hewgley, seconded by Woodruff to adopt Resolution No. 2020-30 to adopt the 2020-2021 fiscal year Lincoln County, NE budget as presented. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
An amended budget notice will be published as required.
Chairman Henry opened the public hearing at 11:30 A.M. to receive comments relating to setting the final tax request at a different amount than the prior year tax request.
No comments were received.
The public hearing was closed at 11:31 A.M.
Motion by Hewgley, seconded by Johnson to adopt Resolution No. 2020-31 setting the final tax request at a different amount that the prior year tax request. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on September 11, 2020; and was also emailed to the media on September 11, 2020.
The agenda for the meetings to be held on Monday, September 21, 2020 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
