Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Johnson offered prayer. Henry called the meeting to order at 9:00 A.M.

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Woodruff, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 19, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Johnson, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Woodruff, seconded by Johnson to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Hewgley, seconded by Weems to authorize the Chairman to sign the Federal Grants and Programs Sub-Recipient Audit Acknowledgement Form for fiscal year from 7-1-2019 to 6-30-2020 for the Victim Assistance Grant. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Weems, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 19, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Woodruff, seconded by Johnson to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Weems, seconded by Woodruff to adopt Resolution No. 2020-40 amending the tax levies for North Platte Public Schools – District #1 bond levies. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln County Board of Commissioners reconvened.

Lincoln County Planning Director, Judy Clark, appeared and stated the planning staff had no objection to the application submitted by Thomas and Kimberly McMichael.

Motion by Weems, seconded by Johnson to approve the application by Thomas and Kimberly McMichael for McMichael Administrative Subdivision located on Fairway Avenue. The subdivision will consolidate two lots into one lot on property described as Lots 5 & 6, Campbell Estates Second Subdivision of part of the SE ¼ of Section 7, Township 12 North, Range 30 West of the 6th P.M., Lincoln County, NE. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Hewgley, seconded by Woodruff to set November 16, 2020 at 10:00 A.M. to accept bids for motor graders for the Lincoln County Department of Roads

Commissioner Hewgley requested the County Highway Supt., Carla O’Dell, get the board a list of motor graders with specific information such as year, # of hours, condition, etc. and also requested a plan for 3-5 years out for replacement.

Commissioner Woodruff asked what the average number of hours is on the motor graders we are trading in.

O’Dell responded that the average is around 20,000 hours.

Commissioner Weems asked how long it takes to get 20,000 hours or service on a motor grader. He also asked about the possibility of getting no motor graders this year or maybe only one this year instead of three.

O’Dell replied that we are trading two 1998 machines and one 2001 machine.

Upon roll call vote Hewgley, Henry, Johnson and Woodruff voted “aye”. Weems voted “nay”. Motion carried.

Motion by Woodruff, seconded by Johnson to go into closed session at 9:47 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Chairman Henry restated the motion for the closed session.

Motion by Johnson, seconded by Woodruff to go into open session at 10:00 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Advance notice and the agenda for the October 26, 2020 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on October 23, 2020; and was also emailed to the media on October 23, 2020.

The agenda for the meetings to be held on Monday, November 2, 2020 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
