Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Jerry Woodruff and County Clerk, Rebecca Rossell.  Commissioner Johnson was absent. Weems offered prayer. Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Woodruff, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 23, 2020.  Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”.  Nays, none. Johnson absent.

 

Motion by Weems, seconded by Hewgley to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”.  Nays, none.   Johnson absent.

 

Motion by Woodruff, seconded by Weems to receive and order filed the fee report submitted by the County Sheriff.  Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”.  Nays, none.  Johnson absent.

 

Motion by Hewgley, seconded by Weems to cancel the regularly scheduled Lincoln County Board of Commissioners and Board of Equalization meeting on Monday, December 28, 2020.  Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”.  Nays, none.  Johnson absent.

 

Motion by Woodruff, seconded by Weems to close all non-emergency county offices at 12:00 noon on December 24, 2020.  Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”.  Nays, none.  Johnson absent.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Deputy County Assessor, Pat Collins appeared.

 

Motion by Weems, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 23, 2020. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”.  Nays, none. Johnson absent.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Discussion was held concerning a petition submitted by Richard Jr. and Kim Konyek requesting a vacation of a portion of Sea Street and unfinished boat ramp in Jeffrey Fjords Estates 2 in Brady, Nebraska.

 

Konyek’s stated they are requesting the portion owned by Lincoln County to be vacated and added to their parcel so they could build a garage on it which would be added to the tax roll.  They have not seen maintenance by the county on this road in three years.

 

Commissioner Weems expressed concern that if the county vacates a portion of the cul-de-sac area if it would harm another person’s property now or in the future.

 

John and Jane Knippenberg, property owners of the adjoining parcel stated various reasons why they did now wish this area owned by the Lincoln County to be vacated.  They do not want a building in the area that would block their view.  They commented that Konyek’s had not contacted them concerning the request to have the road vacated.  They reported that the county does not come very often but they do grade the road.

 

Commissioner Weems asked if the existing right-of-way could still be maintained if the county vacated the road and if there was a home owners association.

 

Knippenbergs replied there is a home owners association.  The area requested to be vacated was supposed to be a public access area.  They are also concerned about drainage down to the cove area is this area is vacated.

 

Deputy County Attorney, Tyler Volkmer, reported that he lives in this area so he did not sign the petition.  He did not know of a home owners association but there are covenants.  His current understanding is that when this subdivision was platted it was dedicated to the county.

 

Commissioner Hewgley stated he was concerned about the property owner that would be directly affected by this vacation was not contacted by the petitioner.

 

Volkmer replied that looking at the statutory process for a vacation of a county road, all property owners that touched this road would be notified.

 

Konyek’s stated there is history with the adjoining property owners but they do want them to have the necessary access to their property.

 

Commissioner Hewgley asked Konyek’s how much waterfront they would gain if this area was vacated.

 

Konyek’s responded that it would give them more waterfront if the area was added to their parcel.

Motion by Hewgley, seconded by Woodruff to direct the County Highway Supt. to do a written study on the county road that they are requesting Lincoln County to vacate by petition which was submitted by Rick and Kim Konyek, which includes a portion of Sea Street and an unfinished boat ramp in Jeffrey Fjords Estates as per statutory requirements.  Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”.  Nays, none.  Johnson absent.

Advance notice and the agenda for the November 23, 2020 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on November 25, 2020; and was also emailed to the media on November 25, 2020.

 

The agenda for the meetings to be held on Monday, December 7, 2020 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
