Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell. Woodruff offered prayer. Weems called the meeting to order at 9:00 A.M.
Chairman Weems announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Bruns, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 4, 2021. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Bruns to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to receive and order filed fee reports submitted by County Sheriff, Clerk of District Court, Register of Deeds and County Clerk. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Bruns to appoint Bill Henry as the Lincoln County representative for Sandhills RC & D. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Hewgley to authorize the Chairman to sign the special designated liquor application submitted by Callaway Market LLC for a reception at the Lincoln County Fairgrounds Ag Building on October 30, 2021. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Bruns to authorize the Chairman to sign the special designated liquor application submitted by GL Concepts dba Good Life on the Bricks for a reception at Harbor Lights on October 30, 2021. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Bruns to authorize the Chairman to sign the Certificate of Cost Allocation Plan for the fiscal year ending June 30, 2020 with Maximus concerning indirect costs for child support enforcement. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Hewgley to authorize the Chairman to sign the right of way application submitted by Dawson Public Power District.
Commissioner Hewgley questioned if the county had any liability if we allow a power line in the county right-of-way.
Aaron Edwards from DPPD responded that the power district has power lines in right-of-ways in this county as well as other counties.
Upon roll call Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:22 A.M. and the Lincoln County Board of Equalization convened.

Deputy County Assessor, Pat Collins appeared.
Motion by Woodruff, seconded by Bruns to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 4, 2021. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
Motion by Bruns, seconded by Woodruff to adopt Resolution No. 2021-33 setting the 2021 tax levies for all political subdivisions headquartered in Lincoln County. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:27 A.M. and the Lincoln County Board of Commissioners reconvened.
Public hearing was opened at 9:30 A.M. regarding the application of Old Depot Vineyard and Winery, 33651 E Banner Road, Brady, NE for a Class K catering license.
Jeff Miller appeared to represent the winery. They feel the catering license will give them opportunity to have more flexibility for tastings off site, marketing and they would be able to hold more events.
The public hearing was closed at 9:34 A.M.
Motion by Hewgley, seconded by Bruns to recommend to the Nebraska Liquor Control Commission favorable comment for the Class K application submitted by Old Depot Vineyard and Winery. Motion carried.
Motion by Bruns, seconded by Woodruff to set November 1, 2021 at 10:20 A.M. to accept bids for a pickup truck for Region 51 Emergency Management. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
County Treasurer, Alex Gurciullo, appeared to present a summary concerning her request to close four Lincoln County bank accounts and to open one new account.
Motion by Woodruff, seconded by Bruns to adopt Resolution No. 2021-34 to close accounts held in Lincoln County’s name at Union Bank & Trust per recommendation of the County Treasurer. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Woodruff to adopt Resolution No. 2021-35 to close accounts held in Lincoln County’s name at Nebraska Public Agency Investment Trust per recommendation of the County Treasurer. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to adopt Resolution No. 2021-36 to close accounts held in Lincoln County’s name at Flatwater Bank per recommendation of the County Treasurer. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Bruns to adopt Resolution No. 2021-37 to close accounts held in Lincoln County’s name at Hershey State Bank per recommendation of the County Treasurer. Upon roll call vote Hewgley, Weems and Bruns voted “aye”. Woodruff voted “nay”. Motion carried.
Motion by Bruns, seconded by Woodruff to adopt Resolution No. 2021-38 to open accounts held in Lincoln County’s name at Western Nebraska Bank per recommendation of the County Treasurer. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Commissioner Bruns reported that he had talked with the City of North Platte concerning the questions about the network service, emergency management and maintenance of roads agreements.
There are two full time employees that work for the county in network services so the language in the contract was correct.
Motion by Bruns, seconded by Woodruff to enter into an interlocal agreement with the City of North Platte for Network Services ending September 30, 2023. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Bruns stated that after looking at the office space provided by the city and time spent working with the other two counties in the region, it appears to be a fair split.
Motion by Woodruff, seconded by Bruns to enter into an interlocal agreement with the City of North Platte for Emergency Management Services from October 1, 2021 to September 30, 2022. Upon roll call vote Hewgley, Weems, Bruns and Woodruff voted “aye”. Nays, none.
Commissioner Bruns commented that after looking at the maps for the South Buffalo Bill road maintenance, it appears this area was not annexed by the city.
Commissioner Hewgley questioned why the city would pave a county road.
The interlocal agreement with the City of North Platte for maintenance of roads in the County’s jurisdiction was tabled for additional research.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on October 8, 2021; and was also emailed to the media on October 8, 2021.
The agenda for the meetings to be held on Monday, October 18, 2021 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
