Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Micaela Wuehler, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell. Bruns offered prayer. Weems called the meeting to order at 9:00 A.M.
Chairman Weems announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Hewgley, seconded by Bruns to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 13, 2021. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Bruns to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Woodruff to receive and order filed the fee report submitted by the County Sheriff in the amount of $2441.48. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Wuehler to authorize the Chairman to sign a right-of way application submitted by CenturyLink. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Commissioner Woodruff and project consultant, Tom Werblow, appeared to brief the board on Change Order No. 7 for the Detention Center addition/remodel project.
Motion by Woodruff, seconded by Bruns to authorize the Chairman to sign Change Order #7 for the Lincoln County Detention Center Addition and Remodel Project in the amount of $29,138.42.
Commissioner Hewgley asked that they make sure there is not a double payment to Troyer’s Welding for work done on the modesty screens.
Commissioner Woodruff replied that they would look for that in pay application No. 15.
Upon roll call vote Weems, Wuehler, Bruns and Woodruff voted “aye”. Nay, none. Hewgley was present but did not vote.
The Lincoln County Board of Commissioners recessed at 9:26 A.M. and the Lincoln County Board of Equalization convened.

Motion by Woodruff, seconded by Bruns to authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real and personal property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by Maranatha Bible Camp as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:33 A.M. and the Lincoln County Board of Commissioners reconvened.
Discussion was held concerning change orders to the Lincoln County Courthouse 2nd & 3rd Floor Bathroom remodel project. Commissioner Wuehler explained that the change order request was to even up/shore up existing walls. The Building Committee has talked with Lee Davies, the architect for the project, about the change. Dowhower Construction has submitted a change order request in the amount of $15,900.00. This was considerably higher than the cost that was anticipated. The Building Committee requested that this change order be tabled for further review. The Building Committee also stated that work can continue on the project while the change order is under review.
Motion by Wuehler, seconded by Woodruff to authorize the Chairman to sign the Nebraska Office of Highway Safety mini grant application (Drive Sober or Get Pulled Over) for the Lincoln County Sheriff’s Office in the amount of $10,000.00. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Wuehler to adopt Resolution No. 2021-41 for re-districting of the Lincoln County Commissioner Districts using 2020 Census data as required per Nebraska State Statute §32-553(1) (c). Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Jill Falcon and Meghan Trevino appeared in person for the request of West Central District Health Department for CARES Act funds. Executive Director, Shannon Vanderheiden, appeared via Zoom. The health department met with legal counsel and Commissioner Bruns to develop a list of potential items that could be funded as follows with the following items that have already been expended: Global Cooling – $6,801.59; Hall’s Electric – $8,646.98; Johnson Controls – $40,400.00; Condon Signs – $882.96; Bear Constructions – $4,627.00; Larry’s Glass – $790.34; and Payroll expenses from 8-1-2021 – 12-24-2021 – $73,915.69. The following items requested have not been expended: Retention Policy – $121,234.35 and purchase of Ford vehicles – $91,925.86. Total funds requested: $349,224.77.
Deputy County Attorney, Tyler Volkmer, reported that compliance has been addressed and that he is comfortable with the items on the list.
County Clerk, Rebecca Rossell, informed board members that there is approximately $291,000 left in the CARES Act Funds that had been received by the county.
Volkmer stated that the health district can figure out what they want to do with the funds allotted.
Motion by Bruns, seconded by Woodruff to approve the request of West Central District Health Department for the balance of unencumbered CARES Act Funds (after pending claims) for the uses itemized on today’s list and allow them to prioritize funding for such items. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Amber Kuskie, of West Central Development District presented the proposed guidelines for the Nebraska State and Local Fiscal Recovery Funds.
Motion by Woodruff, seconded by Hewgley to approve the Lincoln County, Nebraska State and Local Fiscal Recovery Funds Program Guidelines as presented and authorize the Chairman to sign. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Discussion was held concerning the State and Local Fiscal Recovery Funds applications received. Amber Kuskie, of West Central Development District, was present to give a brief summary of each application. She related if they met program guidelines and if the request was a priority established by the County Board. Also noted is that there will be contracts with these recipients in the future.
Motion by Woodruff, seconded by Bruns to approve the application submitted by North Platte Catholic Community Food Pantry in the amount of $10,000.00 to be used as outlined in the application. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Woodruff to approve the application submitted by The Salvation Army in the amount of $50,000.00 to be used as outlined in the application. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Hewgley to approve the application submitted by Scott Robinson in the amount of $8,900.00. Upon roll call vote “ayes”, none. Hewgley, Weems, Wuehler, Bruns and Woodruff voted “nay”. Motion denied.
Motion by Bruns, seconded by Hewgley to approve the application submitted by Diane Osbon in the amount of $83,000.00. Upon roll call vote “ayes”, none. Hewgley, Weems, Wuehler, Bruns and Woodruff voted “nay”. Motion denied.
Motion by Woodruff, seconded by Wuehler to approve the application submitted by Grace Ministries Food Pantry in the amount of $14,151.20 to be used as outlined in the application. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Bruns, seconded by Woodruff to approve the application submitted by Hope’s Cupboard Food Pantry in the amount of $8,000.00 to be used as outlined in the application. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
The application by Episcopal Church of Our Savior in the amount of $40,000.00 was tabled for additional information.
Motion by Woodruff, seconded by Hewgley to approve the application submitted by Brady Food Pantry in the amount of $1,200.00 to be used as outlined in the application. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye’. Nays, none.
The application by Deborah’s Legacy in the amount of $6,100.00 was tabled for additional information.
Motion by Bruns, seconded by Wuehler to approve the application submitted by First Church of the Nazarene DBA Parkview Kids Christian Learning Center in the amount of $130,350.00. Upon roll call vote “ayes”, none. Hewgley, Weems, Wuehler, Bruns and Woodruff voted “nay”. Motion denied.

The County Board conducted a quarterly inspection of the Lincoln County Detention Center.
The meeting was adjourned at 12:55 P.M.
Advance notice and the agenda for the December 20, 2021 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on December 17, 2021; and was also emailed to the media on December 17, 2021.
The agenda for the meetings to be held on Monday, January 3, 2022 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
