Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Micaela Wuehler, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell. Woodruff offered prayer. Bruns called the meeting to order at 9:00 A.M.
Chairman Bruns announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Hewgley, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 8, 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Wuehler to authorize the Chairman to sign special designated liquor application for a wedding reception at Old Depot Vineyard & Winery on 9-24-2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to authorize the Chairman to sign special designated liquor application for a private party at Old Depot Vineyard & Winery on 9-22-2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Wuehler to adopt Resolution No. 2022-15 directing the Lincoln County Highway Supt. to do a study on a portion of Somerset Road owned by Hasenauer Acres, LLC, concerning possible vacation. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to receive and order filed the fee report submitted by the County Sheriff for $2255.51. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Wuehler to authorize the Chairman to sign an interlocal agreement with Keith County for inmate housing at Lincoln County Detention Center. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared along with Deputy County Treasurer, Sheri Newton.

No certificates of correction or refund submitted by the County Assessor.
Motion by Weems, seconded by Woodruff to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to approve the motor vehicle tax exemption application submitted by Community Action Partnership of Mid-Nebraska as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Wuehler, seconded by Woodruff to approve the notice of valuation change numbered 2022-009 as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:24 A.M. and the Lincoln County Board of Commissioners reconvened.
Susan Maline, CPA, presented the preliminary fiscal year 2022-2023 Lincoln County budget. The preliminary budget used the 2021 valuation amount and included the additional 1% for the lid calculation.
Motion by Weems, seconded by Woodruff to authorize the Region 51 Emergency Management Director, Brandon Myers, to attend the International Association of Emergency Managers conference in November 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Emergency Management Director, Brandon Myers, reported that he had done research concerning a generator for the Lincoln County Courthouse. He is recommending a generator from NMC. It can be purchased through a cooperative agreement with a government entity know as Sourcewell.
Commissioner Hewgley commented that in the past we have still went through a bidding process.
The generator with both options would $132,610. The additional electrical work would cost approximately $47,416.20 for a total grand project amount of $180,416.20. Myers reported that the Building and Grounds department will do the concrete work and fencing.
The generator for the Lincoln County Courthouse was tabled. Commissioner Weems will work with EM Director, Brandon Myers, on the project.
Highway Supt., Jason Schultz, reported they had received three quotes from Murphy Tractor, Bobcat of North Platte, and Titan Machinery for the rental/lease of a skid steer. They recommend the rental/lease with Titan Machinery for one year.
Motion by Woodruff, seconded by Wuehler to approve the annual rental/lease of skid steer with Titan Machinery in the amount of $4500.00. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Highway Supt., Jason Schultz, also presented a price for a scraper in the amount of $218,500 from NMC procured through Sourcewell. They are planning to keep the current scraper owned by the County. The new one would be utilized primarily by the road building crew.
Schultz told board members, that in this case, the purchase through Sourcewell fits. He agrees that competitive bidding for other items should be used.
Commissioner Weems supports the purchase, but asks they do some research on the machine and that we have its history.
Motion by Woodruff, seconded by Wuehler to authorize the Lincoln County Highway Supt. to inspect the scraper (purchase pending upon inspection of machine and service records) and authorize the Chairman to sign the necessary paperwork for purchase if all checks out. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
District Court Judge Piccolo and Lincoln County Building Supt., Jeff Higgins, appeared to discuss the requested 3rd floor remodel for District Court Judges. Judge Piccolo stated that state funds would be used to help develop part of the conference room area into a room for hearings. Lawyers would then convene in the jury room when not in use. The current conference room would also be converted to a secretarial area. The project would consist of drywall, a suspended ceiling in the hallway with additional lighting and electrical. They are estimating a cost of $10,000.00.
Commissioner Hewgley questioned what happens if there is a jury in the jury room.
Judge Piccolo replied that if there is a jury trial, the lawyers will not be able to assemble in that location. There is usually nothing else on the schedule if there is a jury trial. He would like to see the District Court area be efficient and appear more professional.
Higgins commented that if the bookshelves are removed, then they have an issue with replacing the carpet.
Commissioner Wuehler stated that she had already looked at the area and it appears to be a well thought out plan.
Judge Piccolo also talked about appropriate signage which was include in the $10,000 estimate.
County Board members will look at the bookshelves and area for viability of proposed remodel.
Discussion concerning an additional bailiff for District Court Judges was tabled at the Judges request.
Motion by Woodruff, seconded by Wuehler to go into closed session at 11:08 A.M. to discuss potential real estate purchases. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Chairman Bruns restated the motion for the closed session.
