Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Micaela Wuehler, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell.  Bruns offered prayer. Bruns called the meeting to order at 9:00 A.M.

 

Chairman Bruns announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 7, 2022.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Wuehler, seconded by Weems to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Wuehler to receive and order filed the fee report submitted by the County Clerk for $950.62.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared along with Sheri Newton, Deputy County Treasurer.

 

Motion by Weems, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 7, 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Hewgley, seconded by Weems to approve the motor vehicle tax exemption application submitted by the Salvation Army and recommended for approval by the County Treasurer.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Wuehler, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by First Church of the Nazarene and recommended for approval by the County Treasurer.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Weems, seconded by Wuehler to approve the motor vehicle tax exemption application submitted by Region II Human Services and recommended for approval by the County Treasurer.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Public hearing was opened at 9:31 A.M. to consider action on an application by Dawn Jessup for a conditional use permit to allow construction of a special events venue in a TA-1 Transitional Agricultural District on property located at 17863 E State Farm Road and described as Lot 1 Mildred Administrative Subdivision of part of Government Lot 6 in the Fort McPherson Reservation in Section 6, Township 12 North, Range 28 West of the 6th P.M., Lincoln County, Nebraska.

 

Planning Director, Judy Clark, gave a summary from the Planning Commission meeting.  The Planning Commission had no objections to the application with the following conditions attached:  1) a fence be constructed around the entire perimeter with the exception of the driveway; 2) remove the lean-to and trees for parking; 3) cannot have a bathroom or kitchen without addressing septic issue and addressing the Planning Commission board; and 4) occupancy cannot exceed approved parking.

 

Commissioner Woodruff questioned the septic concerns and asked if there were more details about the fence.

 

Clark replied that the applicant plans to use port-a-potties.  This site is one lot that sites in the middle of row crops.  The fence was required to decrease liability for both property owners.  The Planning Commission had no specifications about what type of fence.

 

Commissioner Woodruff then asked if future special designated liquor permits had been discussed.

 

Clark responded that this had not been discussed at the planning level.

 

Dawn Jessup, the applicant, reported that she wants to make this property into a wedding venue and the house on the property an Air B & B.

 

Bruce Dodson, representing the adjoining landowner, reported that they were opposed to the project originally due to concerns about trespassing and hazards.  They will not oppose the project if they are contained by a fence. He will discuss with the applicant about a commercial business policy to address liabilities since there will be no resident manager on site to view the actions of the guests.

 

Commissioners again discussed concerns about what type of fence would be installed and liability issues.

 

Jessup stated she plans to put up a 4 ft. or 6 ft. chain link fence around the perimeter.

 

The public hearing was closed at 9:49 A.M.

 

Motion by Weems, seconded by Woodruff to approve the application by Dawn Jessup for a conditional use permit to allow construction of a special events venue in a TA-1 Transitional Agricultural District on property located at 17863 E State Farm Road and described as Lot 1 Mildred Administrative Subdivision of part of Government Lot 6 in the Fort McPherson Reservation in Section 6, Township 12 North, Range 28 West of the 6th P.M., Lincoln County, Nebraska as recommended by the Lincoln County Planning Commission, and all elements of the application are complied with and with the following conditions: 1) a fence be constructed around the entire perimeter with the exception of the driveway; 2) remove the lean-to and trees for parking; 3) cannot have a bathroom or kitchen without addressing septic issue and addressing the Planning Commission board; and 4) occupancy cannot exceed approved parking.  Based on the following factual findings, to wit:  1) The application complies with current Lincoln County Zoning Regulations; 2) The application complies with current Lincoln County Subdivision Regulations; and 3) The application is in conformance with the current Lincoln County Comprehensive Plan and Lincoln County Zoning Map.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Jason Schultz, Lincoln County Highway Supt., appeared to discuss the acceptance of a bid for three new ½ ton 4-wheel drive 4 -door pickup trucks for the Lincoln County Department of Roads.  He said the pickup trucks bid by Janssen Chrysler were SSV’s geared toward law enforcement and not toward the use of the road department.  He researched utilizing one of the State of Nebraska contracts for bids.  Anderson Ford of Lincoln has 2023 Ford F-150’s that will be available at a price of $50,795 per truck or a total of $152,385 for the three units.  Availability is a big issue right now with vehicles.

 

Commissioner Wuehler asked where this price fit into the department budget.

 

Schultz stated that it would still be under our current budget.

 

Motion by Woodruff, seconded by Wuehler to reject the previous bid from Janssen Chrysler Dodge for $118,482 as the SSV’s did not meet the specifications.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Wuehler to authorize the Lincoln County Highway Supt. to accept the state bid procedure to purchase 3 new ½ ton 4-wheel drive 4-door pickup trucks (Ford F-150’s) from Anderson Ford of Lincoln in the amount of $152,385.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

The following bids were received for a used wheel loader for Lincoln County Department of Roads:  Murphy Tractor – $164,000; NMC – Option 1 – $165,000, Option 2 – $160,000.

 

Motion by Wuehler, seconded by Hewgley to accept the bid of Murphy Tractor in the amount of $164,000 for a 2018 Deere 624K with 4868 hours with limited warranty.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Weems, seconded by Woodruff to set December 5, 2022, at 10:00 A.M. to accept bids for four pickup trucks for the Lincoln County Sheriff’s Office with their specifications.  Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”.  Nays, none.

Advance notice and the agenda for the November 14, 2022, board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall, and the Lincoln County website on November 10, 2022; and was also emailed to the media on November 10, 2022.

 

The agenda for the meetings to be held on Monday, November 21, 2022, will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
