Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Micaela Wuehler, Chris Bruns, Jerry Woodruff, County Clerk, Rebecca Rossell and Melissa Wilson. Joe Hewgley offered prayer. Bruns called the meeting to order at 9:00 A.M.
Chairman Bruns announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Wuehler to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 28, 2022. Upon roll call vote Wuehler, Hewgley, Weems, Woodruff, and Bruns voted “aye”. Nays, none. Abstain, Weems.
Motion by Weems, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Woodruff, Wuehler, and Bruns voted “aye”. Nays, none.
Motion by Wuehler, seconded by Hewgley to cancel the Tuesday, December 27, 2022, Board of Commissioners and Board of Equalization meetings. Upon roll call vote Weems, Woodruff, Wuehler, Hewgley and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems authorizing the Chairman to sign Certificate of Cost Allocation for fiscal year ending June 30, 2021, for Maximus (child enforcement reimbursement). Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to authorize the Chairman to sign an amended Memorandum of Understanding between the Nebraska Emergency Management Agency and Lincoln County and Hitchcock County. Upon roll call vote Wuehler, Hewgley, Weems, Woodruff and Bruns voted “aye”. Nays, none.
Motion by Hewgley, seconded by Wuehler to adopt Resolution 2022-32 for year-end certifications of the County Highway Superintendent Year 2022 and authorize the Chairman to sign. Upon roll call vote Hewgley, Weems, Woodruff, Wuehler and Bruns voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared along with Deputy County Treasurer, Sheri Newton.
Motion by Woodruff, seconded by Wuehler to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 28, 2022. Upon roll call vote Weems, Woodruff, Wuehler, Hewgley and Bruns voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
Motion by Hewgley, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by Great Plains Health as recommended for approval by the County Treasurer. Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.
Sheriff Deputy Dan Newton discussed the alcohol enforcement NOHS grant at the end of December for Lincoln County Sheriff’s Office and would like additional deputies December 16th thru January 1st. He doesn’t have an issue with getting the extra help. Motion by Weems, seconded by Woodruff to accept the Alcohol Law Enforcement Grant and authorize the Chairman to sign. Upon roll call vote Wuehler, Hewgley, Weems, Woodruff and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Wuehler to adopt Resolution 2022-33 amending Sunday liquor sales in Lincoln County and authorize the Chairman to sign. This would allow on and off sales of alcohol from 6:00 A.M. to 1:00 A.M. Monday through Sunday and will repeal Resolution 98-14. There was no opposition from Law Enforcement. Upon roll call vote Hewgley, Weems, Woodruff, Wuehler and Bruns voted “aye”. Nays, none.
Noxious Weed Department Supt., Todd Herndon, did the repairs above the garage door and looks good. He brought pictures of the work and the board agreed that the repair looks good. He reported that the downspouts need to be moved underground to help with the flooding of the lot, the lot also needs graded, the garage door needs replaced, and the exterior of the building will need to be painted.
No action was taken.
Board members discussed the bids on four ½ ton, crew cab, 4-door, 4-wheel drive pickup trucks for the Lincoln County Sheriff’s Office. One bid was opened at the meeting from Janssens and a representative from Bill Summers Ford spoke on how the production of the pickups we need are behind. He was unsure when they would be ready for production. Jerome Kramer, Dan Newton and Rolly Kramer from the Sheriff’s Office were present for discussion.
This will be tabled until the next meeting.
Motion by Weems, seconded by Woodruff to adopt Resolution 2022-34 concerning a Land Survey Corner Preservation Agreement with the State of Nebraska and authorize the Chairman to sign. This will be a 5-year Master Agreement and Boni Edwards had no issues. Upon roll call vote Weems, Woodruff, Wuehler, Hewgley and Bruns voted “aye”. Nays, none.
Motion Hewgley, seconded by Weems to authorize Craig Dirrim to send a formal settlement demand for Old Republic Surety Company & NEBCON. Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Hewgley to go into closed session at 10:20 A.M. to discuss pending litigation. Upon roll call vote Wuehler, Hewgley, Weems, Woodruff and Bruns voted “aye”. Nays, none.
Chairman Bruns restated the motion for the closed session.
Motion by Woodruff, seconded by Weems to go into open session at 10:41 A.M. Upon roll call vote Hewgley, Weems, Woodruff, Wuehler and Bruns voted “aye”. Nays, none.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall, and the Lincoln County website on December 2, 2022; and was also emailed to the media on December 2, 2022.
The agenda for the meetings to be held on Monday, December 12, 2022, will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
