Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Micaela Wuehler, Chris Bruns, Jerry Woodruff, Kent Weems, Deputy County Clerk, Melissa Wilson. Kent Weems offered prayer. Bruns called the meeting to order at 9:00 A.M.
Chairman Bruns announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Wuehler to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 19, 2022. Upon roll call vote Woodruff, Wuehler, Woodruff and Bruns voted “aye”. Nays, none. Weems abstains.
Motion by Woodruff, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Woodruff, Hewgley, Weems, Wueher, and Bruns voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to receive and order filed the fee report for the Lincoln County Sheriff’s Office $4168.19 and Clerk of District Court $7461.32. Upon roll call vote Hewgley, Weems, Wuehler, Woodruff, and Bruns voted “aye”. Nays, none.
Motion by Wuehler, seconded by Weems to approve the audit report of Lincoln County ending July 1, 2021, through June 30, 2022.
Weems asked about the rebate program, which needs to be fixed and tightened up.
Wuehler stated she’d look into it.
Upon roll call vote Wuehler, Weems, Hewgley, Woodruff and Bruns voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger spoke on the certificates of correction and refund on lease hold value. Two were needing corrected and then will be going back out.
Motion by Hewgley, seconded by Weems to resend the motion on certificates on 2611-2612 and the correction be re-submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Wuehler, Woodruff and Bruns voted “aye”. Nays, none.
County Assessor, Julie Stenger spoke on collecting 2023 taxes on a mobile home that will be moving to Cozad.
Motion by Weems, seconded by Woodruff to approve collecting 2023 taxes on the mobile home. Upon roll call vote Weems, Woodruff, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.
County Assessor, Julie Stenger spoke on a 25% personal property penalty on Pepper Jacks Development and refunding Deer Credit Incorporated for double payment.
Motion by Woodruff, seconded by Weems to approve the 25% personal property penalty on Pepper Jacks Development and refunding Deer Credit Incorporated for double payment. Upon roll call vote Woodruff, Weems, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.
County Treasurer, Alex Gurciullo spoke on six motor vehicle tax exemption applications.
Motion by Hewgley, seconded by Woodruff to approve five motor vehicle tax exemption applications submitted by Maranatha Bible Camp as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Woodruff, Weems, Wuehler, Weems and Bruns voted “aye”. Nays, none.

Motion by Weems, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by Goodwill Industries as recommended for approval by the County Treasurer. Upon roll call vote Weems, Woodruff, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to approve the motor vehicle tax exemption application submitted by North Platte Catholic Schools as recommended by the County Treasurer. Upon roll call vote Woodruff, Weems, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:29 A.M. and the Lincoln County Board of Commissioners reconvened.
Motion by Woodruff, seconded by Hewgley to set the Region 51 Emergency Management Director’s salary for 2023 at $65, 220.00. Upon roll call vote Woodruff, Hewgley, Weems, Wuehler and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Wuehler to set the Veterans Service Officer salary for 2023 at $55, 437.00. Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Wuehler to the Lincoln County Noxious Weed Supt., salary for 2023 at $ 54,176.00 and a $2000.00 merit raise. Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
Commissioner Wuehler spoke on how pleased she is with the Lincoln County Noxious Weed Supt. and couldn’t be happier with his work ethic and willingness to learn and implement new things.
Motion Woodruff, seconded by Wuehler to set the Lincoln County Highway Supt. Salary for 2023 at $92,000.00.
Commissioner Hewgley questioned why such a big stair step and asked why we couldn’t do smaller steps to get to the same result.
Commissioner Weems was in agreeance with Commissioner Hewgley. They both felt the work he was doing was spot on but didn’t feel it necessary to make such a huge step.
Chairman Bruns stated that the money we will be saving and the money coming in, it was warranted.
Upon roll call vote Woodruff, Wuehler and Bruns voted “aye”. Hewgley and Weems voted nay.
Motion by Woodruff, seconded by Hewgley to reappoint Brandon Myers as the Region 51 Emergency Management Director for 2023. Upon roll call vote Woodruff, Hewgley, Weems, Wuehler and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to appoint Thomas Gann as the Veterans Service Office for 2023. Upon roll call vote Woodruff, Weems, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Wuehler to reappoint Todd Herndon as Lincoln County Noxious Weed Supt. for 2023. Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Wuehler to reappoint Jason Schultz as Lincoln County Highway Supt. for 2023. Upon roll call vote Woodruff, Wuehler, Hewgley, Weems and Bruns voted “aye”. Nays, none.
Motion by Weems, seconded by Wuehler to accept the application of TinaMarie Fernandez for the 2023 Extension Board. Upon roll call vote Weems, Wuehler, Hewgley, Woodruff and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Hewgley to accept with considerable reservation the retirement notification of Building and Grounds Supervisor, Jeff Higgins February 15, 2023.
Jeff Higgins stated he’d be willing to help out on and off if needed.
Upon roll call vote Woodruff, Hewgley, Weems, Wuehler and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Hewgley to go into closed session at 10:21 A.M. to discuss strategy with respect to pending or imminent litigation, real estate purchase, deployment of security personnel and devices or evaluation of job performance as to prevent needless injury to reputation. Upon roll call vote Woodruff, Hewgley, Weems, Wuehler, and Bruns voted “aye”. Nays, none.
Chairman Bruns restated the motion for the closed session.
Motion by Woodruff, seconded by Weems to go into open session at 10:55 A.M. Upon roll call vote Woodruff, Weems, Hewgley, Wuehler, and Bruns voted “aye”. Nays, none.
Chairman Bruns adjusted the agenda.
Motion by Weems, seconded by Woodruff to authorize Commissioner Hewgley to sign Settlement Agreement between Old Republic Surety Company (“Old Republic”), and Nebcon, Inc., and County of Lincoln. Upon roll call vote Weems, Woodruff, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to approve the Board Secretary to post the job listing for Building and Grounds Supervisor at the appropriate pay range based on experience and 40-hour work week.
Chairman Bruns stated the pay range to $24.00-$33.00 based on qualifications.

Motion by Hewgley, seconded by Woodruff to approve Resolution 2023-01 appointing county depositories: NebraskaLand Bank of North Platte, NebraskaLand Bank of Lincoln, First National Bank of Omaha of North Platte, First National Bank of Omaha of Lincoln, Adams Bank and Trust of Ogallala, Adams Bank and Trust of North Platte, Adams Bank and Trust of Lincoln, Bankers Bank of the West of Denver, CO, First State Bank of Lincoln, Western Nebraska Bank of North Platte and Western Bank of North Platte. Upon roll call vote Hewgley, Woodruff, Wuehler and Bruns voted “aye”. Nays, none. Abstain Weems.
Motion by Weems, seconded by Woodruff to adopt the 2023 Mileage Rate that matches the IRS rate effective January 1, 2023, from the Department of Administrative Services to $0.655 per mile for use of a personal vehicle, which means the County Sheriff can charge a rate of $0.685 on civil processing upon roll call vote Weems, Woodruff, Hewgley, Wuehler and Bruns voted “aye”. Nays, none.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall, and the Lincoln County website on December 16, 2022; and was also emailed to the media on December 16, 2022.
The agenda for the meetings to be held on Tuesday, January 17, 2023, will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
