Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Micaela Wuehler, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell. Wuehler offered prayer. Bruns called the meeting to order at 9:00 A.M.
Chairman Bruns announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Wuehler to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 22, 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Weems, seconded by Wuehler to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 22, 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Deputy County Attorney, Stephen King, reported on his research concerning the appeal of TERC decisions. Lincoln County would have the burden of proof for an appeal.
County Board and County Assessor stated that the county is required to follow state statute using the income approach. They are wondering why TERC overturned the decision using an appraisal.
Following discussion, the County Board directed the County Attorney’s Office to appeal the verdict on the TERC decision on property owned by Western Tabor Ranch Apartments LLC.
The Lincoln County Board of Equalization adjourned at 9:34 A.M. and the Lincoln County Board of Commissioners reconvened.
Motion by Hewgley, seconded by Weems to adopt Resolution No. 2022-16 by Lincoln County determining the final allocation of levy for political subdivisions under the county levy limit. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Wuehler, seconded by Hewgley to approve exceeding the budget limit by an additional one percent (1%) for the 2022-2023 fiscal year Lincoln County budget. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to set September 29, 2022, at 10:00 A.M. for public hearing to receive comments on the proposed 2022-2023 fiscal year Lincoln County budget. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Wuehler to set September 29, 2022, immediately following the close of the budget hearing for the purpose of receiving comments relating to setting the final tax request at a different amount than the prior year (Only if needed, depending on Joint Public Budget Hearing). Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to approve the purchase of a generator for the Lincoln County Courthouse from NMC with the two options included in the amount of $132,610 as bid through SourceWell and utilizing ARPA funds. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to approve and authorize the Chairman to sign the addendum to the Summit Food Contract for the Lincoln County Detention Center effective September 1, 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Wuehler to authorize the Chairman to sign the
memorandum of understanding with the North Platte Chamber and Development
Corporation for lease of Greenbrier property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Wuehler to approve in accordance with the
Memorandum of Understanding a donation of ARPA funds in the amount of $4.5 million
dollars to North Platte Chamber for the purchase of the Greenbrier property. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to approve the 2022 inventory forms submitted by all county offices. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.

The agenda for the meetings to be held on Tuesday, September 5, 2022, will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.
