Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Roethemeyer offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Roethemeyer to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 26, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve the special designated liquor permits submitted by Sculleys LLC for 2 events to be held on September 7, 2013 & September 27, 2013 at the Creekside Event Center. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve and authorize the Chairman to sign the DOJ Equitable Sharing Agreement & Certification from the County Attorney’s Office. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve entering The county of Lincoln, Nebraska, into a contract with Norfolk Contracting, Inc., in regards to the Stark Road Over Birdwood Creek Bridge Replacement Project for the Lincoln County Roads Department, Project Number LCDOR-2013-3, and authorize the Lincoln County Board Chairman to sign the written contract for The county of Lincoln, Nebraska. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as Sue Fleck, County Treasurer.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 26, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Roethemeyer, seconded by Deterding to approve the motor vehicle tax exemption applications by North Platte Baptist Church and North Platte Catholic Schools as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve the motor vehicle tax exemption applications submitted by North Platte Opportunity Center as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Henry Vogt, representing the County Assessor’s Office, reported on the protest of special valuation application submitted by Donald Norton.

 

Mrs. Norton appeared by telephone.

 

Henry stated that there are two parcels and one parcel has more accretion acres than the other parcel. The parcel being protested is the one that has a majority of agricultural land.

 

Mrs. Norton told Commissioners that the land has been rented and cattle have been run on it for a number of years. Via fax she sent a copy of the agreement concerning this matter.

 

Motion by Roethemeyer, seconded by Deterding to reverse the decision of the County Assessor and grant the special valuation application on the parcel presented. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Kathy Shimmin and County Assessor, Julie Stenger, appeared concerning the protest of rejection of homestead exemption application. Stenger the physicians forms was marked that she did not qualify for the exemption so she really had no choice but to disapprove the application.

 

Motion by Deterding, seconded by Roethemeyer to deny the protest of rejection of homestead exemption application submitted by Kathy Shimmin. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Jack Adams appeared to protest his notice of valuation change and informed board members that he was presenting a Bill of Sale stating that the real property was valued at $390,000 and the personal property (tractor) was valued at $15,000. The tractor was not separated out on all the paperwork for the appraisal.

 

Motion by Roethemeyer, seconded by Deterding to deny the appeal on notice of valuation change based on the Assessor’s recommendation as submitted by Jack Adams. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Lenora Gordon appeared to protest her notice of valuation change. She commented that the County Assessor came out and inspected the property and reappraised it with both buildings. The buildings are used for storage. The new valuation is still higher than the current bank appraisal.

 

Henry Vogt, representing the County Assessor’s Office, stated that she had filed a protest in June and then withdrew it. The appraisal was done for re-financing purposes. The property card only had one storage building initially and now it has the house and two storage buildings.

 

Motion by Deterding, seconded by Roethemeyer to deny the appeal on notice of valuation change based on the Assessor’s recommendation as submitted by Lenora Gordon. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to approve the notice of valuation changes numbered 2013-049 thru 2013-051 as submitted by the County Assessor. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

County Assessor, Julie Stenger, commented that Stampede Farms LLC had filed a personal property return with all zeros. The Assessor’s office put the original amounts back in the return. After further correspondence the County Assessor now agrees to the zero value.

 

Motion by Deterding, seconded by Roethemeyer to grant the protest with a zero value as recommended by the County Assessor for Stampede Farms LLC. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization recessed at 10:09: A.M. and the Lincoln County Board of Commissioners reconvened.

 

Judy Clark, Planning Director, stated that this parcel was surveyed back in 1972 before Comprehensive Planning, but was not given a title. This will make it a legal subdivision with a proper title.

 

Motion by Deterding, seconded by Roethemeyer to approve File No. SU13-00 an application by Mick Brosius for Brosius Administrative Subdivision. This subdivision has been applied for to gain clear title to the property. The property is described as part of the NE ¼ of Section 6, Township 13 North, Range 27 West of the 6th P.M Lincoln County, Nebraska in a TA-1 Transitional Ag District southeast of Maxwell on McCullough Road. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

A budget work session was conducted.

Advance notice and the agenda for the September 3, 2013 board meetings were sent to members of the County Board, County Attorney and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, September 9, 2013 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
