Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Roethemeyer offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 4, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion Hewgley, seconded by Roethemeyer to approve and adopt Resolution No. 2014-12 transferring excess funds from the Institution Fund to the General Fund as the Institution Fund is no longer utilized. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the fee reports submitted by the County Clerk, Register of Deeds and Clerk of District Court. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 4, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Robert Crouse appeared stating he was protesting the classification of his property by the County Assessor not the value.

 

Commissioner Hewgley questioned how 10 acres could make a monetary profit and fit into the special valuation regulations.

 

Crouse responded that state statute does not refer to size of the parcel or how much you have to make monetarily from it.

 

Julie Stenger, County Assessor, stated they felt the agricultural use was minimal so they denied the request. The regulations refer to agriculture as a livelihood and questioned if 10 acres could support this. It also refers to a special influence being present. The classification of a property cannot be changed with a special valuation protest.

 

Motion by Roethemeyer, seconded by Hewgley to approve to uphold the Assessor’s recommendation and deny the special valuation protest submitted by Robert J. Crouse. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the motor vehicle tax exemption application submitted by Great Plains Health as recommended by the County Treasurer. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:45 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Roethemeyer to approve setting the date of September 15, 2014 at 10:00 A.M. for public hearing to receive comments on the proposed 2014/15 fiscal year Lincoln County, NE budget. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve setting the date of September 15, 2014 at 10:30 A.M. for public hearing for the purpose of receiving comments relating to setting the final year tax request at a different amount than the prior year. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve exceeding the budget limit by an additional 1% for the 2014/2015 fiscal year Lincoln County, NE budget. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Lisa Burke and Clarine Eickhoff, representing the NP/LC Visitor’s Bureau reported that it is the acknowledgement clarifying the process of how the first right of refusal would take place after the initial 10 year agreement.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the Chairman to sign the acknowledgement and clarification between KS Plus, Inc. and the County of Lincoln, Nebraska – North Platte/Lincoln County Visitors Bureau concerning the Sublease agreement for office space. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Jerry Hitchcock, Lincoln County Highway Supt., commented that the county’s lease was not renewed to pump gravel. He suggested the county sell the gravel pumping equipment through Big Iron Auction which has nationwide advertising and has no expense to the seller.

 

Commissioner Hewgley asked about researching the area to see if the county could find another land owner who might be willing to let us pump gravel and discuss possible options.

 

Motion by Deterding, seconded by Roethemeyer to approve declaring a one complete working gravel pumping operation – includes, boat, pump and engine, stinger (with cable and cable reel), pontoons, gravel pipe, tower (with grizzly and screen) and sand line, which has been used by the Lincoln County Roads Department for its gravel pumping operation, to be surplus property that is obsolete or unusable by the County.  Upon roll call vote Roethemeyer and Deterding voted “aye”. Hewgley voted “nay”. Motion carried.

 

Motion by Roethemeyer, seconded by Hewgley to approve setting the value in excess of $2500 on the surplus property, which is obsolete or unusable by the County, described as one complete working gravel pumping operation – includes boat, pump and engine, stinger (with cable and cable reel), pontoons, gravel pipe, tower (with grizzly and screen) and sand line. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve authorizing Big Iron Auction to conduct an auction online of one complete working gravel pumping operation – includes boat, pump and engine, stinger (with cable and cable reel), pontoons, gravel pipe, tower (with grizzly and screen) and sand line, which is surplus and unusable by the County, by means (ways) allowed under Neb. Rev. Stat. §23-3115 and authorize the Chairman to sign any necessary documents and to also authorize Jerry Hitchcock, Lincoln County Highway Supt., to be the contact person. Upon roll call vote Roethemeyer and Deterding voted “aye”. Hewgley voted “nay”. Motion carried.

 

Motion by Roethemeyer, seconded by Deterding to approve declaring the county’s various items located at the Lincoln County Roads Department gravel pit to be surplus personal property, which is obsolete or unusable by the County. The list of items being considered are attached to this Agenda, marked as Exhibit A, and are listed as follows: One Pearson Gravel Pump – needs work, One Spits Gravel Pump – needs work, Approximately 165’ of 16” Plastic sand pipe – Average condition, 6 – 4’X20’ and 2-4’X10’ Pontoon floats – good condition, and approximately 130’ of 8” steel gravel pipe, elbows, flanges and misc. screens. Upon roll call vote Roethemeyer and Deterding voted “aye”. Hewgley voted “nay”. Motion carried.

 

Motion by Roethemeyer, seconded by Deterding to approve setting the value in excess of $2500 on each item listed above (Exhibit A) which is surplus personal property which is obsolete or unusable by the County. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve authorizing Big Iron Auction to conduct an auction online of the surplus personal property listed above (Exhibit A), which is unusable by the County, by means (ways) allowed under Neb. Rev. Stat. §23-3115 and authorize the Chairman to sign any necessary documents and to also authorize Jerry Hitchcock, Lincoln County Highway Supt., to be the contact person. Upon roll call vote Roethemeyer and Deterding voted “aye”. Hewgley voted “nay”. Motion carried.

 

Motion by Roethemeyer, seconded by Hewgley to approve entering The county of Lincoln, Nebraska, into a contract with the Nebraska Department of Revenue Property Assessment Division for the continuation of a Computer Assisted Mass Appraisal System. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

A 2014/15 county budget work session was held.

Advance notice and the agenda for the August 11, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, August 18, 2014 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
