Meeting of the Lincoln County Board of Commissioners. Present were Commissioners  Joe Hewgley, Kent Weems, Bill Henry, Walt Johnson, Jerry Woodruff, and Deputy County Clerk, Terry Heessel.  Weems offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Woodruff, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 22, 2019.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Motion by Henry, seconded by Weems to receive and order filed the treasurer’s receipts.  Upon roll call vote Henry, Weems, Johnson, Woodruff, and Hewgley voted “aye”.  Nays, none.

Motion by Johnson, seconded by Henry to receive and order filed fee report submitted by the County Treasurer.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Motion by Henry, seconded by Weems to appoint Chairman Hewgley and Commissioner Woodruff to the Personnel Committee as per Resolution 2019-03.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Motion by Henry, seconded by Weems to receive and order filed the Condition of the Treasury of Lincoln County, Nebraska from July 1, 2018 to December 31, 2018. Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 22, 2019. Upon roll call vote Henry, Weems, Johnson, Woodruff, and Hewgley voted “aye”.  Nays, none.

County Assessor, Julie Stenger was present.

No certificates of correction and refund were submitted by the County Assessor.

County Assessor, Julie Stenger and County Appraisers, Charity Farley and Henry Vogt were present to discuss rent-restricted housing projects Parkland Estates II, L.P. and Luke Estates, L.P.

Motion by Johnson, seconded by Henry that this board, based on the facts and circumstances presented to us by the Lincoln County Assessor and her representatives on January 22, 2019, concur with the Lincoln County Assessor that the income-approach calculation under Neb. Rev. Stat. §77-1333 in regards to the rent restricted housing project (10 Units) of Parkland Estates II, L.P., does not result in valuation that is the actual value for the 2019 tax year, and therefore petition the Nebraska Tax Equalization & Review Commission to consider the Lincoln County Assessor’s utilization of another professionally accepted mass appraisal technique on Parkland Estates II, L.P., rent-restricted housing project, for the 2019 tax year, which we hereby adopt and approve by our signatures on the petition and have the Lincoln County Attorney and her deputies represent us.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

The Lincoln County Board of Equalization adjourned at 9:29 A.M. and the Lincoln County Board of Commissioners reconvened.

Motion by Henry, seconded by Johnson to set February 19, 2019 at 10:00 A.M. for the public hearing on the One & Six Year Road Plan for Lincoln County, Nebraska.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Emergency Management Director, Brandon Myers gave the quarterly report for October 1, 2018 through December 31, 2018.

Jada Venezie, Health and Human Services and Mike Montgomery, Adams and Swanson Funeral Home, representative of Nicole Long, was present to discuss the general assistance appeal for burial of Brenda Long.

Exhibit 1 was received and accepted, showing the request for Lincoln County Burial/Cremation, denial of application for assistance and the appeal for fair hearing.

Mr. Montgomery explained the process, and that the application was not made in the allotted time because the daughter, Nicole Long, travels because of her job and could not be located.  Ms. Venezie stated that the application would have been approved if application had been filed within the next business day.

Deputy County Attorney, Joe Wright, advised the board to go into closed session to discuss the matter.

Motion by Weems, seconded by Henry to go into closed session at 10:10 AM.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Chairman Hewgley restated the reason for going into closed session.

Motion by Henry, seconded by Weems to go into open session at 10:30 AM.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Motion by Woodruff, seconded by Weems that in regards to appeal case #2019-01 the board finds evidence that there being lack of due process and the applicant is qualified to receive a waiver for a cremation of Brenda Long to grant the appeal.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

Approved the following claims as presented for payment:

The meeting was recessed at 10:48 AM and reconvened at 12:00 PM for the meeting with Elected Officials and Department Heads.

The meeting was adjourned at 1:00 P.M.

Advance notice and the agenda for the January 28, 2019 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on January 25, 2019; and was also emailed to the media on January 25, 2019.

The agenda for the meetings to be held on Monday, February 4, 2019 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
