Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Weems offered prayer. Chairman Henry called the meeting to order at 9:00 A.M. Commissioner Hewgley was absent.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Johnson, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 24, 2020 as amended to correct it to read Vice Chairman Weems in the Board of Equalization portion. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Woodruff, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Weems, seconded by Johnson to approve and authorize the Chairman to sign the two (2) right of way applications submitted by Consolidated Company. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

County Assessor, Julie Stenger appeared as well as a representative of the County Treasurer’s Office.

 

Motion by Woodruff, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 24, 2020. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Weems, seconded by Johnson to approve the motor vehicle tax exemption application submitted by North Platte Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Woodruff, seconded by Johnson to approve the motor vehicle tax exemption application submitted by American Red Cross as recommended for approval by the County Treasurer. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Johnson, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by Riverside Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Weems, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by New Life Assembly as recommended for approval by the County Treasurer. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Weems, seconded by Woodruff to declare the County’s surplus personal property (large conference table stored on the 4th floor of the Lincoln County Courthouse) to be surplus property, which is obsolete or unusable by the county. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Weems, seconded by Johnson to authorize Building & Grounds Director, Jeff Higgins, to research the relative market value of the large conference table with a local expert. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Ashley Miller, who is hosting the fundraiser for Habitat for Humanity pertaining to the application by Big Red Liquor appeared to answer questions about the event. She is expecting approximately 100 people. The two servers will have the required training.

 

Commisioners required wristbands be used for the event.

 

Sheriff Kramer called Big Red Liquor and confirmed details with management. He stated he had no issue with the application.

 

Motion by Johnson, seconded by Woodruff to approve and authorize the Chairman to sign a special designated liquor permit submitted by Big Red Liquor for a corn hole tournament on March 15, 2020 at Lincoln County Fairgrounds. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

The following informal bids were received for fencing on the South River Road Reconstruction Project:

 

Walker Stewart         Phase 1 – $4400.00, Phase 2 – $12,065.00 (which includes the $1800 in Phase 3 that can be deducted), Phase 3 – $1800.00

 

Mill Iron W LLC         Phase 1 – $1800.00 if we store salvage fence, $2200.00 if they need to store salvage fence, Phase 2 – $10,666.00, Phase 3 – $1000.00

 

Commissioner Woodruff and Highway Supt., Carla O’Dell, will review the informal bids and make a recommendation to the County Board.

 

Motion by Weems, seconded by Woodruff to accept the two informal bids for review with the exception on Phase 2 of the informal bid submitted by Walker Stewart. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

 

Motion by Johnson, seconded by Weems to go into closed session at 10:15 A.M. for the

following reasons, to-wit (1) discussion regarding deployment of security personnel and

the ramifications from it, (2) threat of allegations which indicate imminent litigation

against the County, (3) attorney client privilege regarding the matters, and (4) clearly

necessary for the protection of the public interest. The above are all tied in together.

Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Hewgley absent.

Chairman Henry restated the motion for the closed session.

 

Motion by Weems, seconded by Johnson to go into open session at 10:54 A.M. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley absent.

The meeting was adjourned at 11:00 A.M.

 

Advance notice and the agenda for the March 2, 2020 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on February 28, 2020; and was also emailed to the media on February 28, 2020.

 

The agenda for the meetings to be held on Monday, March 9, 2020 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
