Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Henry offered prayer. Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 24, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to approve the Special Designated Liquor Permit submitted by Good Life on the Bricks for an event at Harbor Lights on September 19, 2020 and authorize the Chairman to sign. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Weems to adopt Resolution No. 2020-25 to enter into an interlocal agreement with the Village of Sutherland to provide library services for 2 years. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to adopt Resolution No. 2020-26 to enter into an interlocal agreement with the Village of Brady to provide law enforcement services for 4 years and authorize the Chairman to sign. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to approve and authorize the Chairman to sign the annual Peopleware renewal agreement for software used in the Register of Deeds office. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:17 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Weems, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 24, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Hewgley to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to agree with the County Assessor on Protest 2020-01 to reduce the valuation from $4250 to $0 on the Personal Property Valuation Protest filed by KCW Enterprises, LLC and authorize the Chairman to sign. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:32 A.M. and the Lincoln County Board of Commissioners reconvened.
Deb McGee appeared for Nebraska Bar & Grill concerning the special designate liquor license application. Sheriff Kramer requested that guests be ID’d and banded at the entry door.
Motion by Johnson, seconded by Woodruff to approve the Special Designated Liquor Permit submitted by Nebraska Bar & Grill of Gothenburg for an event to be held at Harbor Lights on October 17, 2020 and authorize the Chairman to sign. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Commissioner Hewgley reported that the county is looking at drilling a test well, possibly in the SW corner of the block hopefully in the next couple of weeks. There will be a team of people to investigate. It will be difficult to estimate an exact cost of the testing.
Commissioner Weems commented that this situation is unique because you have to do analysis as you go with multiple companies.
Motion by Hewgley, seconded by Weems that due to the unique and/or noncompetitive nature of items and related remediation work to be performed on existing geothermal system at the Lincoln County Courthouse in accordance with Neb. Reb. Statute 23-3109(1) (a) that the county will forego the normal bidding process. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Johnson to authorize Sargent Irrigation of Broken Bow to be part of a team of consultants and authorize them to investigate and test the well system for possible remedies for the HVAC system issues. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Sheriff Kramer reported that if the JAG grant funds are approved in the amount of $11,733 for riot gear, it would be shared with the Lincoln County Sheriff’s Office.
Motion by Weems, seconded by Woodruff to approve and authorize the Chairman to sign the Memorandum of Understanding with the City of North Platte concerning the FY 2020 JAG Program funding. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to go into closed session regarding deployment of security personnel or devices, and to protect attorney client privileges, which is clearly necessary to protect the public interest at 10:07 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Henry restated the motion for the closed session.
Motion by Weems, seconded by Woodruff to go into open session at 10:32 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

The agenda for the meetings to be held on Tuesday, September 8, 2020 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.
