North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, County Clerk, Rebecca Rossell, and Board Assistant, Tammy White.  Roethemeyer offered prayer.  Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Roethemeyer to approve minutes regarding the Lincoln County Board of Commissioners meeting held on March 14, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the fee report submitted by the County Sheriff.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to set April 18, 2011 at 10:30 A.M. to receive bids for asbestos and lead based paint removal of the existing Lincoln County Jail.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:19 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Julie Stenger, Lincoln County Assessor was present.

 

Deputy County Attorney, Joe Wright, arrived at 9:20 A.M.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on March 14, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Jim Einspahr representing Local #831 North Platte appeared to present the application for a special designated liquor license for the North Platte Fireman’s Ball on April 9, 2011 which is a fund raiser.  He commented that they had hired servers from a local catering company to serve the alcohol.

 

Sheriff Kramer asked if the servers had been trained.

 

Einspahr responded that they have been thru server training.

 

Sheriff Kramer then asked about minors at the event.

 

Einspahr replied that it is by invitation only and no one under 21 is allowed.

 

Motion by Hewgley, seconded by Roethemeyer to approve the special designated liquor permit submitted by Local #831 North Platte for an event to be held on April 9, 2011 at Creekside Event Center.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Lincoln County Board of Commissioners conducted interviews for the Lincoln County Noxious Weed Superintendent’s position.  The candidates were asked to wait outside during the interviews of the other applicants.

 

The first applicant interviewed was Todd Boller.

 

The second applicant interviewed was Steven Kramer.

 

Motion by Hewgley, seconded by Roethemeyer to go into closed session at 10:20 A.M. to prevent needless injury to the reputation of an individual unless the individual requests a public hearing.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Hewgley, seconded by Roethemeyer to go into open session at 10:30 A.M.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

The third applicant interviewed was Glenn Callaway.

 

Motion by Hewgley, seconded by Roethemeyer to go into closed session at 10:50 A.M. to prevent needless injury to the reputation of an individual unless the individual requests a public hearing.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Hewgley, seconded by Roethemeyer to go into open session at 10:53 A.M.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to offer conditional employment to Todd Boller to begin in two to three weeks and authorize the chairman to negotiate with Boller specifically regarding salary but not limited to that.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Richard Nelson & Lance Hastings of Nebraska Game & Parks appeared to discuss maintaining access to Wapiti WMA used for public hunting.  Three sections of ground were purchased for approximately 1 million dollars and they were told there were laid out county roads when they purchased it. A new landowner has put up three gates with padlocks and a fence on the easement that allows access to the state management area.  They are questioning why there are 3 gates on the road other than to discourage people from using it and expressed concern that the easement will be difficult to maintain due to the distance between the fences.  This access is off of Cottonwood & Effenbeck.

 

Commissioner Deterding asked what reason the landowner had for installing the gates.

 

Lincoln County Highway Supt., Jerry Hitchcock, stated the Carl Emmitt owned the property and that cattle were mentioned when he visited with him.  He realizes he cross- sectioned his pasture.  Jerry found a filed deed stating it as possible easement.  He found information that the public requested a road but has not found any official action to make it a county road.

 

Commissioner Hewgley asked when the deed was filed.

 

Hitchcock responded in 1968.  He commented that the land owner wants to control public access to his private land and that Game & Parks wants access for public hunting areas.

 

Nelson expressed that Nebraska Game & Parks bought one million dollars worth of property and that they had come to the county and were assured they had public access and that access needs to be maintained.

 

Commissioner Hewgley voiced that the first thing we need to do is find out what kind of road it is.

 

Commissioner Deterding asked about the possibility of installing an auto gate.

 

Hitchcock concurred that the first thing we need to do is find out what kind of road it is.  An auto gate would cost approximately $4500.

 

Chairman Deterding directed the Lincoln County Highway Supt. to do some additional research on the road.

Advance notice and the agenda for the March 21, 2011 board meetings were sent to members of the county board, county attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City hall and on the county website.

 

The agenda for the meetings to be held on March 28, 2011 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioner’s Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioner’s Room at 9:15 A.M.
