Meeting of the Lincoln County Board of Commissioners. Present were Commissioners
Joe Hewgley, Duane Deterding, Willis Roethemeyer, Board Assistant, Tammy White,
Deputy County Attorney, Joe Wright and County Clerk, Rebecca Rossell. Deterding
offered prayer. Chairman Hewgley called the meeting to order at 9:02 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for
public review and the County Board will comply with the open meeting requirements.
Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the
Lincoln County Board of Commissioners meeting held on March 22, 2010. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to receive and order filed the
treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to authorize the Chairman to sign the
annual equitable sharing agreement & certification report to be submitted by the Lincoln
County Attorney’s Office to the United States Department of Justice. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to authorize the Chairman to sign the
facilities rental agreement for use of the Lake Maloney School for the 2010 election
cycle. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,
none.
Motion by Roethemeyer, seconded by Deterding to approve the substitution of
securities by Hershey State Bank as pledged to the Lincoln County Treasurer. Upon
roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to authorize the Chairman to enter into
a contract with Simon Contractors for constructing the Fleecs Bridge over Birdwood
Creek for the Lincoln County Department of Roads 2010 One Year Road Plan, Project
C56-(0901). A copy of said contract is available at the Lincoln County Clerk’s Office for
public inspection. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”.
Nays, none.
Recess as the Lincoln County Board of Commissioners at 9:16 A.M. and convene as
the Lincoln County Board of Equalization.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Assessor, Mary Ann Long appeared.
Motion by Deterding, seconded by Roethemeyer to approve the minutes regarding the
Lincoln County Board of Equalization meeting held on March 22, 2010. Upon roll call
vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to authorize the Chairman to sign the
certificates of correction and refund as submitted by the County Assessor. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln
County Board of Commissioners reconvened.
Motion by Roethemeyer, seconded by Deterding to set April 19, 2010 at 10:30 A.M. to
receive bids for micro-surfacing for the Lincoln County Department of Roads 2010 One
Year Road Plan. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”.
Nays, none.
County Sheriff, Jerome Kramer, told board members that Deb McCarthy’s term expired
on the Merit Commission in January, 2010. A new elected official will have to be
appointed as Deb has declined to serve another term. After discussion, Commissioner
Hewgley will contact Bob Lindemeier, Public Defender, to see if he would be interested
in serving on the Merit Commission.
Kirk Nichols (Construction Project Inspector/Owners Representative) gave the county
board a construction update on the Lincoln County Jail Project.
Motion by Deterding, seconded by Roethemeyer to go into closed session at 9:51 A.M.
concerning strategy for pending litigation and for the purpose of protecting public
interest. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,
none.
Chairman Hewgley restated the reason for the closed session.
Motion by Deterding, seconded by Roethemeyer to go into open session at 10:05 A.M.
Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
No action was taken following the closed session.
County Board members conducted a quarterly jail inspection.
The meeting was adjourned at 11:45 A.M.
Advance notice and the agenda for the March 29, 2010 board meetings were sent to
members of the County Board, County Attorney and all others requesting the same.
Notice was posted at the Lincoln County Courthouse, City Hall and on the county
website.
The agenda for the meetings to be held on Monday, April 5, 2010 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk.
The regular meeting of the Lincoln County Board of Commissioners will be held at the
Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular
meeting of the Lincoln County Board of Equalization will be held at the Lincoln County
Courthouse in the Commissioners Room at 9:15 A.M.
