Meeting of the Lincoln County Board of Commissioners. Present were Commissioners
Joe Hewgley, Duane Deterding, Willis Roethemeyer, Board Assistant, Tammy White,
and County Clerk, Rebecca Rossell. Commissioner Roethemeyer offered prayer.
Chairman Hewgley called the meeting to order at 9:01 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for
public review and the County Board will comply with the open meeting requirements.
Motion by Deterding, seconded by Roethemeyer to approve the minutes regarding the
Lincoln County Board of Commissioners meeting held on September 7, 2010. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to receive and order filed the
treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to receive and order filed the fee
reports submitted by County Court and Register of Deeds. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to authorize the Chairman to sign the
Grant Award document and Sub-Grant Special Conditions from the Victim Witness
Grant. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,
none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln
County Board of Equalization convened.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Assessor Long and County Treasurer Fleck were both present.
Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the
Lincoln County Board of Equalization meeting held on September 7, 2010. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
No certificates of correction and refund were presented.
Motion by Roethemeyer, seconded by Deterding to approve the motor vehicle tax
exemption applications submitted by North Platte Baptist Church and North Platte
Catholic Schools as approved by the County Treasurer. Upon roll call vote Deterding,
Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to approve the motor vehicle tax
exemption applications submitted by North Platte Opportunity Center as approved by
the County Treasurer. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln
County Board of Commissioners reconvened.
A public hearing was opened at 9:31 A.M. to discuss an Amendment to Section 14.1 of
Article XIV Supplementary District Regulations of Lincoln County’s Zoning Regulations
eliminating Regulation of Windmill Generators and add Regulation for Small Wind
Energy Conversion Systems and Regulation for Commercial/Utility Grade Wind Energy
Conversion Systems to cover Wind Energy Installation.
Judy Clark, County Planning Director, commented that the Planning Commission had
been working on this for some time. They are proposing deleting the old section and
adding a new section to the regulations. The amendment was passed by the Planning
Commission and recommended for approval to the County Board of Commissioners.
Exhibits #1 – 26 were presented and accepted which is the information the Planning
Commission used to create the Wind Power Conversion Regulations.
Commissioner Roethemeyer commented they are not trying to keep wind farms out;
they just want to protect the people in the county.
Nancy Peetz asked why these regulations were not in the old manual.
Judy Clark responded that the farm type windmill generators were in the old manual but
there were no regulations for the new type of wind conversion systems that we have
now.
Jerry Johnson, Logan County Commissioners, asked about a possible discrepancy in
the distance of blades from the ground. One section says 15 feet from the ground and
the other section says 25 feet from the ground for the blades.
Clark replied that 15 feet is for small wind generators and 25 feet refers to commercial
grade applications.
The public hearing was closed at 9:40 A.M.
Chairman Hewgley entered Exhibits #1 -26 used by the Planning Commission while
drafting regulations and submitted by the Lincoln County Attorney’s Office.
No action was taken following the public hearing.
A public hearing was opened at 10:00 A.M. to receive comments on the proposed
2010/2011 fiscal year Lincoln County, NE budget.
Susan Maline, CPA, reviewed the notice of budget hearing and budget summary, lid
calculation and budget and valuation summary.
Ken Main questioned the 35% net cost on interlocal agreements for law enforcement
and how it corresponds to actual costs.
Susan Maline responded that counties are allowed to exclude from the lids for expenses
not reimbursed by the villages.
Ken Main then asked about the Village of Sutherland being reimbursed for storage for
the dive team equipment located in Sutherland.
Nancy Peetz asked various questions about the budgeting process, a land purchase in
the General Fund, tax increases and valuations.
Deputy County Attorney, Joe Wright arrived at 10:21 A.M.
Bob Peterson questioned what the grant funds were being used for that were being
budgeted.
County Clerk, Rebecca Rossell, explained that the grant funds had been moved to a
separate budget within the General Fund this year as most grants are reimbursements.
The grants are for possible law enforcement grants, CDBG funds for housing and
CDBG grant funds for a possible new business near Hershey.
Bernice Zeigler asked questions concerning the allowable increase and the lid
calculation.
Commissioner Hewgley replied that an additional 1% increase is allowed with a super
majority vote of the board for a total of 3.5% otherwise you are allowed 2.5%.
Susan Maline explained that the tax request went down because the county was able to
exclude more last year from the lid calculation. We had to lower the tax request this
year as you cannot exceed the lid limit.
Zeigler stated the public needs to know more information on the budget process.

Commissioner Hewgley acknowledged and thanked the county officials for their
cooperation during this budget process.
Motion by Deterding, seconded by Roethemeyer to adopt Resolution No. 2010-22
establishing the 2010/2011 Lincoln County, NE fiscal year budget. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Kirk Nichols (Construction Project Manger/Owner Representative) and Carol Rouw of
Treanor Architects (appearing by phone) gave a construction update of the Lincoln
County Jail Project.
Approved the following claims presented for payment:
The meeting was adjourned at 12:03 P.M.
Advance notice and the agenda for the September 13, 2010 board meetings were sent
to members of the County Board, County Attorney and all others requesting the same.
Notice was posted at the Lincoln County Courthouse, City Hall and on the county
website.
The agenda for the meetings to be held on September 20, 2010 will be kept continually
current and open for inspection at the Office of the Lincoln County Clerk. The regular
meeting of the Lincoln County Board of Commissioners will be held at the Lincoln
County Courthouse in the Commissioner’s Room at 9:00 A.M. The regular meeting of
the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse
in the Commissioner’s Room at 9:15 A.M.
