Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley,

Duane, Deterding, Willis Roethemeyer, Deputy County Attorney, Joe Wright and County Clerk,

Rebecca Rossell. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:03

A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review

and the county board will comply with the open meeting requirements.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County

Board of Commissioners meeting held on January 3, 2011. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to elect Duane Deterding as Lincoln County Board

Chairman for 2011 and Willis Roethemeyer as Lincoln County Board Vice Chairman for 2011. Upon

roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the treasurer’s receipts.

Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to appoint the North Platte Telegraph as official

newspaper to publish legal notices in 2011. Upon roll call vote Hewgley, Roethemeyer and Deterding

voted “aye”. Nays, none.

Motion by Hewgley, seconded by Roethemeyer to approve and adopt Resolution No. 2011-03

authorizing the County Treasurer to invest county funds for 2011. Upon roll call vote Hewgley,

Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to decrease the securities by NebraskaLand National

Bank as pledged to the Lincoln County Clerk. Upon roll call vote Hewgley, Roethemeyer and

Deterding voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to approve the substitution of securities by First

National Bank as pledged to the Lincoln County Treasurer. Upon roll call vote Hewgley,

Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Hewgley, seconded by Roethemeyer to approve the substitution of securities by Equitable

Bank as pledged to the Lincoln County Treasurer. Upon roll call vote Hewgley, Roethemeyer and

Deterding voted “aye”. Nays, none.

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the fee reports submitted by

the County Treasurer, County Sheriff, Clerk of District Court, County Court and County Clerk. Upon

roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Hewgley, seconded by Roethemeyer to approve and adopt Resolution No. 2011-04

appointing Jerry Hitchcock as the “Responsible Charge” (RC) person for the Project known as

Sutherland North (bridge), NDOR Project No. STPE-BR-1475(5), and NDOR Control No. 61231.

Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to approve and adopt Resolution No. 2011-05

appointing Jerry Hitchcock as the “Responsible Charge” (RC) person for the Project known as

Maxwell Southwest (bridge), NDOR Project No. BR-1480(11), and NDOR Control No. 61414. Upon

roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Hewgley, seconded by Roethemeyer to approve and adopt Resolution No. 2011-06 giving

and granting the Chairman of the Lincoln County Board of Commissioners authority to supervise over

department heads. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays,

none.

The Lincoln County Board of Commissioner recessed at 9:28 A.M. and the Lincoln County Board of

Equalization convened.

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review

and the county board will comply with the open meeting requirements.

County Assessor, Julie Stenger was present.

Motion by Hewgley, seconded by Roethemeyer to elect Duane Deterding as Lincoln County Board of

Equalization Chairman for 2011 and elect Willis Roethemeyer as Lincoln County Board of

Equalization Vice Chairman for 2011. Upon roll call vote Hewgley, Roethemeyer and Deterding voted

“aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County

Board of Equalization meeting held on January 3, 2011. Upon roll call vote Hewgley, Roethemeyer

and Deterding voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the chairman to sign the

certificates of correction and refund as submitted by the County Assessor. Upon roll call vote

Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:30 A.M. and the Lincoln County Board of

Commissioners reconvened.

Motion by Hewgley, seconded by Roethemeyer to reappoint Faith Fisher and appoint Charlotte

Sitorius and Dan Huebner as Lincoln County Representatives to the Lincoln/McPherson Extension

Board for 3 year terms. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays,

none.

Motion by Hewgley, seconded by Roethemeyer to approve the special designated liquor permit

submitted by the Golden Spike Tower for an event to be held on February 4, 2011 at the tower. Upon

roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

A liquor license application for a Class C license was submitted by Louis & Diane Herrick for Unreel

Events LLC dba Unreel Events.

Mr. Herrick stated that owns an RV park and this would be a 300 X 800 foot area adjacent to this area

that he would like to have licensed. He stated they are planning music events for 2011.

Commissioner Hewgley questioned where the fence would be located to enclose this area.

Herrick clarified where the fence would be located and stated that the plan to build a convenience

store type building also in this area.

Commissioners Hewgley expressed his concern about this being such a large area being designated

for alcohol and that there would probably be kids during the special events.

County Sheriff Kramer commented that normally they would see a license application for the building

and then as special designated permits for other events.

Mr. Herrick replied that he did not see any difference between the beer gardens located in town

except this is just a little bigger.

Commissioner Deterding voiced that he had seen 3 events that were being planned for 2011in the

application.

Herrick responded in the affirmative.

Commissioner Deterding asked if there would be a special ingress and egress used just for events.

Commissioner Roethemeyer questioned if they would have to go to the building to purchase alcohol

during events.

Herrick stated that there will probably be a tent used during events only.

Sheriff Kramer related that he did not have a problem with the application, but he would feel more

comfortable with a license in the building and special designated permits for events.

Herrick related that the state had contacted him and asked him to narrow it down to a specific area

with dimensions which he did.

Kevin Motsinger reported that he has been helping Herrick’s get events planned for 2011. Booking

bands can be quite expensive and they do not want to have problem getting a permit. He questioned

the possibility of fencing a smaller area next to the building. He also reported that they had done

research and visited with law enforcement. His commented again that is hard to book events and not

get a liquor permit.

Commissioner Hewgley voiced that special permits are not hard or time consuming to get.

Commissioner Roethemeyer asked Herrick if he would be interested in re-submitting an application

just for the building.

Mr. Herrick rendered that he would like it done as submitted by would be willing to do whatever we

have to make everyone happy.

Commissioner Deterding informed that this was an informal hearing and read him his rights.

There was no opposition to the application from the audience.

Sheriff Kramer again stated he would feel more comfortable with a liquor permit for the building and

possibly a beer garden next to the building with a special permit for the rest of the area to help control

any problems.

Kevin Motsinger again stated he was in approval of the application.

Motion by Hewgley, seconded by Roethemeyer to pass along to the state with unfavorable comment

concerning the liquor license application submitted by Unreel Events LLC dba Unreel Events. Upon

roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Chairman Deterding and Carol Rouw of Treanor Architects (appearing by phone) gave a construction

update of the Lincoln County Sheriff’s Office & Detention Center.

Commissioner Hewgley was excused at 10:53 A.M.

Approved the following claims presented for payment:

The meeting was adjourned at 11:50 A.M.

Advance notice and the agenda for the January 10, 2011 board meetings were sent to members of

the county board, county attorney and all others requesting the same. Notice was posted at the

Lincoln County Courthouse, City Hall and on the county website.

The agenda for the meetings to be held on Tuesday, January 18, 2011 will be kept continually current

and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln

County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners

Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be held at

the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
