SPECIAL SESSION FOR THE LINCOLN
COUNTY BOARD OF COMMISSIONERS
JANUARY 19, 2011
Because the interests of The county of Lincoln, Nebraska, demands it, I, Rebecca J. Rossell, the
Lincoln County Clerk, hereby call a Special Session for the Lincoln County Board of Commissioners
to conduct a special meeting to discuss progress and various items of work of the Lincoln County
Sheriff’s Office & Detention Center in North Platte, Nebraska; and to furthermore consider action
concerning any items discussed regarding the Lincoln County Sheriff’s Office & Detention Center in
North Platte, Nebraska.
The meeting was called to order at 10:02 A.M. by Chairman Deterding.
Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, Board Assistant,
Tammy White, Deputy County Attorney, Joe Wright and County Clerk, Rebecca Rossell.
Also present were Craig Dirrim, legal counsel for Lincoln County, Kirk Nichols, Owners
Representative, Carlin Natnger & Joe Rivielle of Roche Constructors. Appearing by phone were Dan
Rowe and Carol Rouw of Treanor Architects and Sandra Olson, legal counsel for Roche
Constructors.
Motion by Hewgley, seconded by Roethemeyer to go into closed session at 10:04 A.M. to have a
strategy session with respect to a potential litigation regarding the progress and various items of work
concerning the construction of the new Lincoln County Sheriff’s Office & Detention Center and to
protect attorney-client privilege, which is clearly necessary to protect the public interest. Upon roll call
vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Chairman Deterding restated the motion for the closed session.
Motion by Hewgley, seconded by Roethemeyer to go into open session at 11:08 A.M. Upon roll call
vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Craig Dirrim commented that he, Kirk Nichols, Commissioner Roethemeyer, representatives from
Treanor, Roche and Roche’s surety bond company met by telephone yesterday. They discussed the
roof and Roche is in the process of obtaining quotes from subcontractors that will be given to the
county for consideration. Roche has done everything what we have asked them to do to address the
situation and we will continue to work with them in the future to get the problems resolved. Roche’s
surety company and insurance carriers have been notified as well as the roofing subcontractor and its
insurance companies. He also stated that from the legal standpoint all appropriate steps have been
taken to move the process forward.
The meeting was adjourned at 11:15 P.M.
