North Platte, Nebraska

Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, Board Assistant, Tammy White, and Deputy County Clerk, Terry Heessel.  Deterding offered prayer.  Chairman Deterding called the meeting to order at 9:00 A.M.
Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the County Board will comply with the open meeting requirements.

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on May 31, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

Motion by Hewgley, seconded by Roethemeyer to approve the fee report submitted by the County Sheriff.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve the right of way application submitted by Consolidated Companies Inc.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve the agreement with Travel Network Group for an on-line booking system for the North Platte/Lincoln County Convention & Visitors Bureau.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Motion by Roethemeyer, seconded by Hewgley to appoint Cody O’Dell to the North Platte/Lincoln County Convention & Visitors Bureau Advisory Board.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger was present.
Motion by Hewgley, seconded by Roethemeyer to approve the minutes regarding the Lincoln County Board of Equalization meeting held on May 31, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
No certificates of correction and refund were submitted by the County Assessor.
Motion by Hewgley, seconded by Roethemeyer to approve the notice of valuation changes # 001-012 submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
The Lincoln County Board of Equalization adjourned at 9:19 A.M. and the Lincoln County Board of Commissioners reconvened.
Deputy County Attorney, Joe Wright, arrived at 9:25 A.M.
A public hearing was opened at 9:30 A.M. by the Chairman to receive comments on proposed amendments to the standards established in the Lincoln County General Assistance and Medical Assistance Program Regulations and all amendment thereto.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Deputy County Attorney, Joe Wright, reviewed the proposed amendments to the guidelines to 6:204 Cemetery opening/closing, grave site and exterior container.
No comments were received.
The public hearing was closed at 9:34 A.M.
County Roads Superintendent, Jerry Hitchcock, was present to discuss the statewide fracture critical bridge inspections.  This is an annual agreement.
Motion by Hewgley, seconded by Roethemeyer to adopt Resolution 2011-20 to sign a project program agreement with the State of Nebraska Department of Roads regarding statewide fracture critical bridge inspections in Lincoln County and authorize the chairman to sign agreements.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Motion by Hewgley, seconded by Roethemeyer to accept and file warranty deed from Olson Farms Inc. and give chairman authorization to sign the real estate transfer statement.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
County Road Superintendent, Jerry Hitchcock, reviewed the bids opened on May 31, 2011 and presented his recommendation for purchase of motor graders.  His recommendation was to purchase the 2005 John Deer 770D and 2003 John Deer 770CH from Murphy Tractor & Equipment.  The County Board made the following motion based upon that recommendation.
Motion by Roethemeyer, seconded by Hewgley to accept the bid for a 2005 John Deer 770D for $109,000 and a 2003 John Deer 770CH for $82,000 with trade-ins from Murphy Tractor & Equipment for a total purchase of $191,000 with trade-ins.Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
County Assessor, Julie Stenger presented bids for purchase/lease of color copier to replace individual printers, which do not last as long as copiers.  The recommendation of the County Assessor is to lease a used Canon image RUNNER 5180i from Modern Methods, and the funds are available in her budget.  The total cost for 3 years would be $4,320.00 plus service and supply agreement.
Commissioner Hewgley, commented that it maybe just as cost effective to purchase this machine for $5,695.00 instead of leasing.  The Assessor, stated that she does have the funds left in her budget.
Motion by Hewgley, seconded by Roethemeyer to authorize the purchase of a used Cannon image RUNNER 5180icolor copier for the County Assessor’s office.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Commissioner Deterding recommends that Rodney Yost be hired at Lincoln County Weed Superintendent with an annual salary of $37,000.
Motion by Hewgely, seconded by Roethemeyer to appoint Rodney Yost as Lincoln County Weed Superintendent at the annual salary of $37,000.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.
Motion by Hewgley, seconded by Roethemeyer to go into closed session at 10:45 A.M. strategy regarding potential litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest.
Chairman Deterding restated the reason for the closed session.
Chairman Deterding was excused from the meeting at 11:00 A.M.
Motion by Hewgley, seconded by Roethemeyer to go into open session at 11:55 A.M.
Approved the claims presented for payment.
The meeting was adjourned at 11:56 A.M.   Advance notice and the agenda for the June 6, 2011 board meetings were sent to members of the County Board, County Attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.
The agenda for the meetings to be held on Monday, June 13, 2011 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
