Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and Deputy County Clerk, Terry Heessel. Roethemeyer offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Roethemeyer to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 27, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the textile rental agreement with Ideal Linen Supply on floor mats for the Courthouse, DMV, Probation and Jail and authorize the Chairman to sign. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger and County Treasurer, Sue Fleck appeared.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 27, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to authorize the Chairman to sign the certificates of correction or refund on real property as submitted by the County Assessor. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to authorize the Chairman to sign the certificates of correction or refund on personal property as submitted by the County Assessor. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the motor vehicle exemption application submitted by the First Baptist Church on a 1991 and 1997 Ford Van to transport to and from church. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the motor vehicle exemption application submitted by Great Plains Regional Medical Center on a 2012 Dodge Grand Caravan. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the motor vehicle exemption application submitted by Maranatha Bible Camp on a 2005 Chrysler Van. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Roethemeyer to approve Resolution 2014-08 to
Consolidated Connect, Inc., its successors and assigns, a nonexclusive franchise to construct, operate and maintain a cable system in The county of Lincoln, Nebraska, subject to the rules and regulations stated in the Resolution. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the Chairman to sign the proposal for Cut Creek Road Bridge Design at $4250.00 and Hydraulic Study at $2700.00 with MRJ Engineering. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve Resolution 2014-09 giving and granting the Chairman of the Lincoln County Board of Commissioners the authority to approve or deny requests by a department head to become a leave recipient under the catastrophic illness duration program or to approve or deny requests by a department head to become a leave donor under the catastrophic illness duration program. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Discuss options presented to Mr. Dameron. Option agreed upon by all parties involved is to $5,455.00. Mr. Dameron agrees to pay the County $455.00 forthwith and to pay $1,000.00 annually for 5 years.

 

Motion by Hewgley, seconded by Roethemeyer to approve the settlement agreement with Dan Dameron concerning a 2013 weed assessment bill. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to go into closed session concerning strategy regarding imminent litigation(s) and to protect attorney client privilege, which is clearly necessary to protect the public interest at 10:17 A.M. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Roethemeyer, seconded by Deterding to go into open session at 11:14 A.M.

Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

Advance notice and the agenda for the February 3, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, February 10, 2014 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
