Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Deterding called the meeting to order at 9:03 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 3, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the fee reports submitted by the County Sheriff, County Court, County Clerk and Clerk of District Court. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the chairman to sign the right of way permits submitted by Charter Communications. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 3, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization recessed at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.

 

District Court Judge Birch appeared to discuss the request of the Federal Court to use the District Courtroom when it is available if they decide to close the court in the Federal Building. The judges would like to make our courtroom available to them. They have always let the District Judges use the Federal Court when needed it if was available. The Federal Court would like to maintain a presence in western Nebraska.

 

Commissioner Deterding expressed concern about coordination between the two courts.

 

Judge Birch commented that they could provide them with a schedule of availability in advance.

 

Commissioner Hewgley had some possible concerns that would need to be considered: liability, courtroom security, use of the spectrometer and the size of our jury room.

 

Judge Birch stated the jury room should be adequate, the federal government has an equipment procedure that would need to be followed pertaining to the equipment, and his understanding is that Federal Marshalls would provide the security.

 

Commissioner Deterding suggested a one year trial basis for the contract.

 

Commissioner Hewgley expressed concern about the Federal Building being closed in the future.

 

Board directed Deputy County Attorney, Joe Wright, to start working on a contract with the other parties involved.

 

Judy Clark, Planning Administrator, appeared to discuss the application submitted by Todd Schwindt for Schwindt Administrative Subdivision. She reminded the board that with the new comprehensive plan in place this does not need to go through the Planning Commission. Planning Staff has no objections.

 

Motion by Roethemeyer, seconded by Hewgley to approve File No. SU14-002 by Todd Schwindt for Schwindt Administrative Subdivision located on Fairway Drive south of Lake Maloney. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Approved the following claims as presented for payment:

 

The meeting was adjourned at 10:34 A.M.

 

Advance notice and the agenda for the February 10, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Tuesday, February 18, 2014 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
