Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Roethemeyer offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 6, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to place on file the fee reports submitted by the Clerk of District Court, County Sheriff and Register of Deeds. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the special designated liquor permit submitted by Sculleys LLC for a reception to be held at the Lincoln County Fairgrounds on October 25, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the chairman to sign the Equitable Sharing Agreement and Certification for the County Attorney’s Office to be submitted to the Department of Justice & the Department of Treasury. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and adopt Resolution 2014-20 a payroll conversion plan for all employees who work in county departments to begin January 1, 2015. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 6, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Roethemeyer to approve the proposal from Brandy Bogus to perform Juvenile services as described in the Lincoln County Subgrant, #14-CB-501, from the Nebraska Crime Commission for 20 hours per week at $16.00 per hour. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve entering into a Service Contract with the Brandy Bogus as selected to perform juvenile services for Lincoln County as per Subgrant #14-CB-501 for 20 hours per week at $16.00 per hour or $16,080 per year and authorize the Chairman to sign. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the purchase of materials and/or services from the following for the remodel of the new location of the North Platte/Lincoln County Visitors Bureau as submitted:

The following bids for two new or used motor graders for the Lincoln County Department of Roads were received with the trade in allowance deducted for the final bid price:

Motion by Hewgley, seconded by Roethemeyer to approve to table the acceptance of a bid to the October 20, 2014 meeting at 9:30 A.M. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

County Board received the report of the Lincoln County Highway Supt. concerning

Bignell Road (county road) where it borders a tract of land located in the Northeast

Quarter of the Northwest Quarter of Section 35, Township 13 North, Range 29 West of

the 6th P.M., Lincoln County, Nebraska, formerly known as Lot 1, Block 14, in the Village

of Bignell, Lincoln County, Nebraska, now vacated, concerning the possible vacation

or abandonment of the part of the Bignell Road (county road).

 

The Highway Supt. recommends setting a date for public hearing to receive comment on the vacation of said section of South Bignell Road.

 

Motion by Hewgley, seconded by Roethemeyer to approve and adopt Resolution No. 2014-21 setting November 3, 2014 at 9:30 A.M. for public hearing concerning vacation of Bignell Road (county road) where it borders a tract of land located in the Northeast Quarter of the Northwest Quarter of Section 35, Township 13 North, Range 29 West of the 6th P.M., Lincoln County, Nebraska, formerly known as Lot 1, Block 14, in the Village of Bignell, Lincoln County, Nebraska, now vacated, concerning the possible vacation or abandonment of the part of the Bignell Road (county road). Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve Change Order No. 1 for Project RRZ-1390(3) Birdwood/Front Road Viaduct C.N. 61416 and authorize the project RC to sign the necessary documents. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Commissioner Roethemeyer gave an update on the Noxious Weed Superintendent position. He has met with the Darold Miller of the Noxious Weed Board. He is suggesting leaving Justin Dailey as the Interim Weed Supt. until January, 2015 and then decide if the board should re-advertise or make a selection from the prior applicants.

 

Motion by Hewgley, seconded by Roethemeyer to approve entering The county of Lincoln, in the State of Nebraska, into a written contract with Irving P. Hiatt, whereby Irving Hiatt will relocate the Monument, and authorize the Lincoln County Board Chairman to sign the written contract for The county of Lincoln, in the State of Nebraska at the cost of $37,600 and to be completed within 60 days. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve giving written notice to Irving P. Hiatt, which shall state October 13, 2014 for Irving P. Hiatt to commence work on relocation of Monument per written contract and authorize the Chairman to sign. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Paul Grieger of D. A. Davidson appeared by phone. He suggest that there might be some slight changes to the proposed resolutions and suggested that the county might

want to get clarification from bond counsel prior to adopting the documents.

 

Motion by Hewgley, seconded by Roethemeyer to approve continuing the resolution authorizing amendment of Continuing Disclosure Undertakings relating to outstanding bonds. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve continuing the resolution authorizing the review of prior Continuing Disclosure Undertakings and the County’s participation in the SEC’s MCDC Initiative. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

Advance notice and the agenda for the October 13, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, October 20, 2014 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
