Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on June 29, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to place on file the fee report submitted by the County Clerk. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the right of way permits submitted by Consolidated Telephone Company, Inc. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and set July 20, 2015 at 9:30 A.M. for Public Hearing date on a proposed Amendment to the “Zoning Regulations of The county of Lincoln, Nebraska,” recommended by the Lincoln Planning Commission, in which the proposed Amendment amends Article 11 of the “Zoning Regulations of The county of Lincoln, Nebraska,” and is entitled “PROPOSAL AMENDING ARTICLE 11: Amendments,” and furthermore instruct the Lincoln County Clerk to have the Public Hearing advertised (Notice of Public Hearing given) as required by law. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to acknowledge receipt of Resolution No. AM15-002 from the Lincoln County Planning Commission, concerning the proposed amendment titled “Proposal Amending Section 8.09 Livestock Regulations,” which amends Section 8.09 of the “Zoning Regulations of The county of Lincoln, Nebraska.” Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to enter The county of Lincoln, Nebraska, into an agreement with the State of Nebraska Office of the Chief Information Office, an agency of the State of Nebraska, for the purpose of coordinating the use of a Tower and Shelter, located near North Platte, Nebraska, so as to meet the radio communication system needs of the Parties. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:20 A.M. and the Lincoln County Board of Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 29, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

No certificates of correction and refund submitted by the County Assessor.

Motion by Deterding, seconded by Henry to approve the motor vehicle tax exemption application as submitted by North Platte Catholic Schools and recommended for approval by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve the motor vehicle tax exemption application as submitted by Great Plains Health and recommended for approval by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve notice of valuation changes numbered 2015-102 thru 2015-108 as submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve going into closed session at 9:26 A.M. regarding a strategy session concerning pending litigations, and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Deterding, seconded by Henry to approve going into open session at 9:46 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization recessed at 9:47 A.M. and the Lincoln County Board of Commissioners reconvened.

Motion by Deterding, seconded by Henry to approve and give Deputy County Attorney, Joe Wright, authority to sign the Assignment of Judgment regarding contracting with a licensed collection agency (Professional Collection Service) to collect a debt owed to The county of Lincoln, Nebraska, by Shelby J. Acklin a/k/a Shelby J. Kirts, regarding judgment entered on April 5, 2012, by the Lincoln County District Court, Case No. CI 06-450, based on Neb. Rev. Stat. §45-623(2) being complied with. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the Listing Agreement regarding contracting with a licensed collection agency (Professional Collection Service) to collect a debt owed to The county of Lincoln, Nebraska, by Shelby J. Acklin a/k/a Shelby J. Kirts, regarding judgment entered on April 5, 2012, by the Lincoln County District Court, Case No. CI 06-450, based on Neb. Rev. voted “aye”. Nays none.

Motion by Henry, seconded by Deterding to approve and authorize Deputy County Attorney, Joe Wright, authority to sign the Assignment of Judgment regarding contracting with a licensed collection agency (Professional Collection Service) to collect a debt owed to The county of Lincoln, Nebraska, by Alicia D. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve going into closed session at 10:03 attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Deterding, seconded by Henry to approve going into open session at 10:10 Approve the following claims for payment. Motion carried. Recess at 10:35 A.M. as the Lincoln County Board of Commissioners and reconvene as the Lincoln County Board of Equalization. Discussed and considered property valuation protests (Form 422). Recess as the Lincoln County Board of Equalization at 4:59 P.M. and reconvene as the Lincoln County Board of Commissioners.

The Lincoln County Board of Equalization will reconvene at 9:00 A.M. on Friday, July 10, 2015 at the Lincoln County Courthouse in the Commissioners Room to discuss and consider property valuation protests (Form 422).

The meeting was adjourned at 5:00 P.M. Advance notice and the agenda for the July 6, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 2, 2015; and was also emailed to the media on July 2, 2015.

The agenda for the meetings to be held on July 13, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
