Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Henry offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 6, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.    

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the Annual Certification Form for Nebraska Department of Roads for the Highway Buyback Program from 7-1-14 to 6-30-15. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to place on file the fee reports submitted by Clerk of District Court, County Court & Register of Deeds. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign a letter of engagement with McChesney Martin Sagehorn for 2015/16 budget services. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the special designated liquor permits by Sculleys LLC for two receptions to be held on August 1, 2015 at Harbors Lights as well as CB’s Hideaway. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on July 6, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve to accept the letter of explanation for the late filing of the 2015 Homestead Exemption Application by Patricia Dannatt. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve going into closed session at 9:21 A.M. regarding a strategy session concerning pending litigations, and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Deterding, seconded by Henry to approve going into open session at 9:35 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization recessed at 9:35 A.M and the Lincoln County Board of Commissioners reconvened.

Motion by Deterding, seconded by Henry to approve that a Public Hearing be set on a proposed Amendment to the “Zoning Regulations of The county of Lincoln, Nebraska,” recommended by the Lincoln County Planning Commission, in which the proposed Amendment amends Section 8.09 of the “Zoning Regulations of The county of Lincoln, Nebraska,” for the 3rd day of August, 2015, at 10:00 A.M., in the Lincoln County Commissioner’s Room during the regularly scheduled meeting, and instruct the Lincoln County Clerk to have the Public Hearing advertised (Notice of Public Hearing given) as required by law. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization recessed at 12:09 P.M. and reconvened at 1:17 P.M.

The Lincoln County Board of Equalization recessed at 3:44 P.M. and reconvened as the Lincoln County Board of Commissioners.

            Thursday, July 16, 2015 at 6:30 P.M.

            Friday, July 17, 2015 at 9:00 A.M.

The meeting was adjourned at 3:45 P.M.

Advance notice and the agenda for the July 13, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 10, 2015; and was also emailed to the media on July 10, 2015.

The agenda for the meetings to be held on July 20, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
