Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 27, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.    

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and adopt Resolution 2015-10 directing the County Treasurer to issue tax sale certificates on those parcels which are two years delinquent on real estate and special assessments. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve special designated liquor permits submitted by Sculley LLC for the following events:

August 22, 2015- Reception- CB’s Hideaway

September 5 & 6, 2015 – Reception – CB’s Hideaway

Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve special designated liquor permits submitted by Sculley LLC for the following events:

            August 29, 2015 – Reception – CB’s Hideaway

September 29, 2015 – Reception- Lincoln County Fairgrounds

Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on July 27, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve the motor vehicle application submitted by Mid Nebraska Community Action Partnership as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the motor vehicle application submitted by the Salvation Army as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to accept the letter of explanation for the late filing of the 2015 Homestead Exemption Application by Beverly Johnston. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to accept the letter of explanation for the late filing of the 2015 Homestead Exemption Application by Gerald & June Walker. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the notice of valuation changes numbered 2015-113 through 2015-115 as submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:25 A.M. and the Lincoln County Board of Commissioners reconvened.        

Susan Maline, CPA, presented the 2015/16 Preliminary Lincoln County budget document.

                                               

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the Sub Award between the Nebraska Department of Health & Human Services and Lincoln County Attorney for child support enforcement. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

                                                                                                                       

The Public Hearing was opened at 10:01 A.M. on a proposed Amendment to the “Zoning Regulations of The county of Lincoln, Nebraska,” recommended by the Lincoln County Planning Commission, in which the proposed Amendment amends Section 8.09 of the “Zoning Regulations of The county of Lincoln, Nebraska,” and is entitled “Proposal Amending Section 8.09 Livestock Regulations”; and said amendment is in regards to clarification of language and impact easements.

Chairman Hewgley stated that notice is taken with regards to the Lincoln County Comprehensive Plan, Lincoln County Zoning Regulations and Subdivision Regulations, and Lincoln County Zoning Map and those materials are present on the table up front before this County Board.

The following is a written summary of the public hearing:

Bernice Zeigler stated she had no complaint about this particular amendment but is concerned that it is very difficult for the general public to find information on the computer or about where to obtain planning/zoning information.

Planning Director, Judy Clark and Deputy County Attorney, Joe Wright explained the procedures for amending the zoning regulations. They also explained who to contact and where to obtain necessary information pertaining to planning and zoning items.

Chairman Hewgley stated that an individual may need to individually contact the Planning/ Zoning Director or County Clerk to obtain more detailed information if needed.

No other comments were received.

Motion by Henry, seconded by Deterding to approve the mini-grant application to be submitted to the Nebraska Office of Highway Safety by the Lincoln County Sheriff’s Office in the amount of $18,090 for an 18 day national You Drink, You Drive, You Lose campaign. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Master Services Agreement with GIS Workshop, LLC, which provides a web based service that specifically benefits the elected Office of the County Clerk of The county of Lincoln, in the State of Nebraska, and authorize this Board’s Chairman to sign said Agreement on behalf of the Board and the County.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Statement of Work   with GIS Workshop, LLC, marked as Exhibit A.1, and is part of the Master Services Agreement that specifically benefits the elected Office of the County Clerk of The county of Lincoln, in the State of Nebraska, and authorize this Board’s Chairman to sign said Statement of Work on behalf of the Board and the County.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The County of Lincoln, in the State of Nebraska, enter into a Subscription Contract with GIS Workshop, LLC, marked as Exhibit A.2, and is part of the Master Services Agreement that specifically benefits the elected Office of the County Clerk of The county of Lincoln, in the State of Nebraska, and authorize this Board’s Chairman to sign said Contract on behalf of the Board and the County. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

REGARDING LINCOLN COUNTY ASSESSOR

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Master Services Agreement with GIS Workshop, LLC, which provides a web based service that specifically benefits the elected Office of the County Assessor of The county of Lincoln, in the State of Nebraska, and authorize this Board’s Chairman to sign said Agreement on behalf of the Board and the County. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Subscription Contract with GIS Workshop, LLC, marked as Exhibit A.1, and is part of the Master Services Agreement that specifically benefits the elected Office of the County Assessor of The county of Lincoln, in the State of Nebraska, and authorize this Board’s Chairman to sign said Contract on behalf of the Board and the County. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Maintenance and Support Services Contract with GIS Workshop, LLC, marked as Exhibit A.2, and is part of the Master Services Agreement that specifically benefits the elected Office of the County Assessor of The county of Lincoln, in the State of Nebraska, and authorize this Board’s Chairman to sign said Contract on behalf of the Board and the County. REGARDING EMERGENCY MANAGEMENT

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Master Services Agreement with GIS Workshop, LLC, which provides a web based service that benefits the Lincoln County Emergency Management Director and authorize this Board’s Chairman to sign said Agreement on behalf of the Board and the County and to amend said portion of the Agreement where it mistakenly has the Director being an elected office. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Subscription Contract with GIS Workshop, LLC, marked as Exhibit A, and is part of the Master Services Agreement that benefits the Lincoln County Emergency Management Director and authorize this Board’s Chairman to sign said Contract on behalf of the Board and the County. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

REGARDING PLANNING/ZONING

Motion by Deterding, seconded by Henry to approve The County of Lincoln, in the State of Nebraska, enter into a Master Services Agreement with GIS Workshop, LLC, which provides a web based service that benefits the Lincoln County Planning Zoning Administrator and authorized this Board’s Chairman to sign said Agreement on behalf of the Board and the County and to amend said portion of the Agreement where it mistakenly has the Administrator being an elected office. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve The county of Lincoln, in the State of Nebraska, enter into a Subscription Contract with GIS Workshop, LLC, marked as Exhibit A, and is part of the Master Services Agreement that benefits the Lincoln County Planning Zoning Administrator and authorized this Board’s Chairman to sign said Agreement on behalf of the Board and the County. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

County Board conducted a budget work session for the 2015/2016 Lincoln County budget.

Advance notice and the agenda for the August 3, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 31, 2015; and was also emailed to the media on July 31, 2015.

The agenda for the meetings to be held on August 10, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
