Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 3, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.    

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to place on file the fee reports submitted by County Court, County Sheriff, Clerk of District Court, County Clerk and Register of Deeds. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the appointment of Todd Herndon to the Lincoln County Safety Committee for a three year term. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve Resolution #2015-11 for the withdrawal of securities pledged to the County Clerk by NebraskaLand Bank. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 3, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, second by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to go into closed session at 9:16 A.M. regarding a strategy session concerning pending litigations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Deterding, seconded by Henry to go into open session at 9:30 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9: 30 A.M. and the Lincoln County Board of Commissioners reconvened.        

Motion by Henry, seconded by Deterding to set September 14, 2015 at 10:00 A.M. for public hearing to receive comments on the proposed 2015-2016 fiscal year Lincoln County, Nebraska budget. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to set September 14, 2015 at 10:30 A.M. for public hearing for the purpose of receiving comments relating to setting the final tax request at a different amount than the prior year. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve exceeding the budget limit by an additional 1% for the 2015-2016 fiscal year Lincoln County, Nebraska budget. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Update by USDA Wildlife Specialist, Field Supervisor, Chad Richardson explaining that

Seth Tausan has resigned and they will be hiring a new Wildlife Specialist for our area.

Motion by Deterding, seconded by Henry to approve the D.A.R.E. program contracts with the following local school districts for the 2015/2016 school year: Wallace, Sutherland, Hershey, Maxwell and Brady. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none  

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2015-12 authorizing the Chairman to sign the Construction Engineering Services Agreement Supplement No. 3 between Lincoln County, Nebraska and Mainelli Wagner & Associates, Inc. for Project RRZ-TMT-DPU-1390(3) – Control Number 61416 – Birdwood/Front Road Viaduct. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Discussion was held of the application process, obligations, and requirements

concerning applying for a grant from the Nebraska Game and Parks Commission under

the Recreational Trails Program to construct a recreational non-motorized trail of

approximately 1.6 miles in the Lake Maloney area. This also included review of

documentation and requirements concerning applying for the grant and discussion

regarding administrating the grant if received. Participants in the discussion were Dr.

Jim States representing the Lake Maloney Home Owner’s Association, Highway Supt.-

Jerry Hitchcock, Brian Hope of NPPD and Eric Seacrest of Mid Nebraska Foundation.

Also included by telephone were Julie Ogden of JEO Consulting and CJ Poltack of

West Central Nebraska Development District.

More specific topics of the discussion were needing an exact amount for the

commitment, engineering costs for the project, lease agreement, setting up an escrow

account and an escrow agent, maintenance of the project, insurance, grant

administration and reporting on the project.

Chairman Hewgley requested that the home owners association, JEO consulting,

Deputy County Attorney, Joe Wright, CJ of West Central Nebraska Development

District and whomever else involved in the project have a conference call to work

A 2015/2016 budget work session was held.

Advance notice and the agenda for the August 10, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 7, 2015; and was also emailed to the media on August 7, 2015.

The agenda for the meetings to be held on August 17, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
