Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 1, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to place on file the fee reports submitted by the County Sheriff, County Clerk, Register of Deeds and Clerk of District Court. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and authorize the County Board Chairman, Joe Hewgley, to negotiate with the Department of Health & Human Services for office space. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve the special designated liquor license application submitted by Sculley LLC for a reception at Creekside Event Center on September 3, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-40 for the substitution of securities by NebraskaLand National Bank for the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the right of way application submitted by Joe Keiser. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 1, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Deterding, seconded by Henry to approve notice of valuation change 2016-86 as submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization recessed at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Paul Grieger of D. A. Davidson appeared to discuss the possibility of refinancing the Lincoln County 2012 Series Refunding Bonds in the next several months if market conditions allow.

 

Motion by Henry, seconded by Deterding to approve to set September 12, 2016 at 10:00 A.M. for public hearing to receive comments on the proposed 2016/2017 fiscal year Lincoln County, NE budget. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve to set September 12, 2016 at 10:15 A.M. for public hearing for the purpose of receiving comments relating to setting the final tax request at a different amount than the prior year. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve exceeding the budget limit by an additional 1% for the 2016/2017 fiscal year Lincoln County, NE budget. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Dr. Jim States, representing the Lake Maloney Property Owners Association, appeared to discuss the extension of Phase II and the Phase III section of the Lake Maloney Recreational Trail Grant.

 

The property owners association has approved to self-fund the additional 1/10 of mile of trail for Phase II. They would like the county to take ownership of this 1/10 of a mile as well.

 

Phase III will be from where Phase II ends to the inlet at Lake Maloney. The property owners association has approved to pick up the 20% match as they did with Phase II.

 

Further discussion will need to take place between the County, State, Foundation and the Property Owner’s Association concerning the extension of Phase II and the Phase III would be a new grant application process.

 

Carla O’Dell, Lincoln County Highway Superintendent, stated that the Interlocal agreement between the Village of Wellfleet and Lincoln County had expired several years ago. She will contact a representative from the Village of Wellfleet and ask them to appear before the County Board concerning a possible new agreement for snow removal and/or grading of streets within the Village Corporate limits.

 

The Lincoln County Board of Commissioners recessed at 10:33 A.M. and the Lincoln County Board of Equalization reconvened.

 

Motion by Deterding, seconded by Henry to approve going into closed session at 10:33 A.M. concerning strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Deterding, seconded by Henry to approve going into open session at 11:27 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 11:27 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The Lincoln County Board of Commissioners held a budget work session.

Advance notice and the agenda for the August 8, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 5, 2016; and was also emailed to the media on August 5, 2016.

 

The agenda for the meetings to be held on August 15, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
