Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry and County Clerk, Rebecca Rossell.  Deterding offered prayer. Vice Chairman Henry called the meeting to order at 9:00 A.M. Commissioner Hewgley was absent.

 

Vice Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 5, 2016. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and authorize the Vice Chairman to sign the 2015-2016 Nebraska Lottery Annual Report to be submitted by the Nebraska Department of Revenue. Upon roll call vote Deterding and Henry voted “aye”. Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to place on file the fee reports submitted by the Clerk of District Court, County Clerk, Register of Deeds and County Treasurer. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on December 5, 2016. Upon roll call vote Deterding and Henry voted “aye”. Nays, none.  Hewgley absent.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Deterding, seconded by Henry to approve the special designated liquor permit submitted by Golden Spike Tower for a dance to be held at the Golden Spike on December 31, 2016. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve the appointment of Michael Cain to the Veterans Service Committee for the remainder of the five year term to end June 30, 2019 due to the passing of Frank Hultman. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve the appointment of Jerry Jurgens to the Veterans Service Committee for a five year term to end June 30, 2021 due to the resignation of Ken George. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Jim States of the Lake Maloney Property Owners Association reported that the association had approved and remitted payment to the county for the amount that was over the allotted grant awarded for Phase II Lake Maloney Hike and Bike Trail.

 

Motion by Deterding, seconded by Henry to approve to award the bid for Phase II Lake Maloney Hike and Bike Trail (and the extra .10 mile) to Paulsen Inc. in the amount of $285,274.00 for Schedule I and $27,766.50 for Schedule II for a total of $313,040.50. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve to set January 9, 2017 at 10:00 A.M. to receive bids for motor grader blades for the Lincoln County Department of Roads. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve to go into closed session at 10:30 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Vice Chairman Henry stated the reason for the closed session.

 

Motion by Deterding, seconded by Henry to approve to go into open session at 10:55 A.M. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

Advance notice and the agenda for the December 12, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on December 9, 2016; and was also emailed to the media on December 9, 2016.

 

The agenda for the meetings to be held on Monday, December 19, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
