Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 6, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the fee report submitted by the Register of Deeds. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 6, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Deterding, seconded by Hewgley to approve the motor vehicle tax exemption application submitted by Maria Evangelical Lutheran Church of Hershey, NE as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to grant a waiver to Cross of Christ Revival Center to allow the County Assessor to examine the exemption application which was filed after the deadline as per NE State Statute 77-202.01(2) as good cause does exist to allow it. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

 

 

The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln County Board of Commissioners reconvened.

 

A public hearing to receive comments on the One & Six Year Road Plan of Lincoln County, Nebraska was opened at 10:00 A.M.

 

Highway Supt., Carla O’Dell, gave a summary report of the proposed plan.

 

Mike Kelly of Sutherland spoke on the need for the Sutherland North River Bridge project.

 

Eric Seacrest appreciated that the plan encompasses all areas of the county. He suggested they consider placing a West I-80 interchange on the 6 year plan.

 

Mike Cook expressed concern on the condition and usage of Eugene Avenue.

 

The public hearing was closed at 10:46 A.M.

 

Motion by Deterding, seconded by Hewgley to approve adoption of plan following public hearing as presented. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Attorney Brian Davis and petitioner Betty Hoppe-Stevens appeared to answer any questions the County Board might have concerning the petitions presented for the formation of the Village of Farnam Cemetery District.

 

Chairman Henry acknowledged receipt of Exhibit “A” to establish and organize a cemetery district with in Frontier, Dawson, Lincoln Counties and the Village of Farnam under the provisions of Neb. Rev. Stat. §§12-909 to 12-921.

 

Motion by Hewgley, seconded by Deterding to approve the Petition or Petitions to establish and organize a cemetery district within Frontier, Dawson, Lincoln Counties and the Village of Farnam as it does comply with the requirements of Neb. Rev. Stat. §12-909 as per oral testimony and written presentation including Exhibit “A”. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve going into closed session at 11:15 A.M. concerning strategy session regarding litigations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Chairman Henry restated the motion for the closed session.

 

Motion by Hewgley, seconded by Deterding to approve going into open session at 11:45 A.M. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

No action was taken on consider hiring Tim Brouillette, Attorney at Law, as co-counsel in the Cody Fletcher Chapter 13 Bankruptcy case to work with the Lincoln          County Attorney’s office to provide legal representation and protect the County’s interest             in such bankruptcy case as it is no longer necessary.

 

County Board met with elected officials and department heads at noon.

Advance notice and the agenda for the February 13, 2017 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on February 10, 2017; and was also emailed to the media on February 10, 2017.

 

The agenda for the meetings to be held on Tuesday, February 21, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
