Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Henry called the meeting to order at 9:03 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on June 19, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the Chairman to sign lease agreement – addendum #1 with the Nebraska Department of Administrative Services for office space in the Craft State Office Building from July 1, 2017 thru June 30, 2019. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the sales order agreement with Capital Business Systems for a copier/scanner/printer for the County Clerk’s office. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the IRS Form 720 for the PCORI fee. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the special designated liquor permit submitted by Pals Brewing Company LLC for a reception to be held on July 17 at Norder Supply Inc. located at 48063 S Hwy 83, Maywood, NE. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and adopt Resolution No. 2017-13 approving the withdrawal of securities pledged to the Lincoln County Clerk by NebraskaLand National Bank. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign a rental agreement with NMC for a skid steer for the Lincoln County Department of Roads. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign a right of way permit submitted by Aaron Stalker. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:27 A.M. and the Lincoln County Board of Equalization convened.

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Deterding, seconded by Hewgley to approve the notice of valuation changes numbered 2017-031 & 2017-032 as submitted by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization recessed at 9:30 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The public hearing regarding the appointments of Robert McChesney, Merle Honerman & J. D. Hannah to Hospital Authority No. 1 of Lincoln County Board of Directors to serve 6 year terms to expire September, 2023 was opened at 9:30 A.M.

 

Bernice Zeigler asked why the county was involved in the appointments.

 

Deputy County Attorney, Joe Wright, explained that this process is part of Nebraska State Statute.

 

Krystal Claymore of Great Plains Health appeared to answer any questions. She explained that the hospital authority was formed as it is needed to allow the hospital to issue bonds.  The county has no financial responsibility.

 

The public hearing was closed at 9:33 A.M.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2017-14 regarding the appointments of Robert McChesney, Merle Honerman and J. D. Hannah to Hospital Authority No. 1 of Lincoln County Board of Directors to serve 6 year terms to expire September, 2023. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

A public hearing was opened at 9:37 A.M. on an application from Pamela Szwanek, owner, and Michael Noffsinger, purchaser, under File No. Z17-001 proposing a rezoning of property from a R-2 Urban Density Residential District to a C-1 Commercial District located at 149 East North Lake Road, a tract of land located in the SE ¼ of Section 33, Township 13 North, Range 30 West of the 6th P.M., Lincoln County, Nebraska, which in effect is a proposal to Amend the Official Zoning Map of The county of Lincoln, Nebraska, showing such rezoning.

 

County Planning Director, Judy Clark, stated that the site will continue to be used as it has been and that there are other C-1 Commercial District sites located in that area. The Planning Commission accepted the preliminary report and also made the recommendation the final report.  She stated the Lincoln County Highway Supt. had no objections.

 

Michael Noffsinger reported that it will continue to be used for storage and that he might possibly make an office in the future for his truck dispatch service.

 

Mike Montgomery lives behind the property and stated that he is glad that Noffsinger is buying the property and has no problem with what he plans to do with it.

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2017-15, which rezones property from a R-2 Urban Density Residential District to a C-1 Commercial District located at 149 East North Lake Road, a tract of land located in the SE ¼ of Section 33, Township 13 North, Range 30 West of the 6th P.M., Lincoln County, Nebraska, through an Amendment to the Official Zoning Map of The county of Lincoln, Nebraska, showing such rezoning.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the Chairman to sign the 2017 Community Based Juvenile Services grant award and special conditions. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Scott Moses appeared to discuss upgrading the Lincoln County Dive Team trailer. The 16 foot unit they are currently using is out of room.  They would like to replace it with a 20 foot trailer.  He stated he had contacted three companies to get bids but had only received one response.

 

Commissioner Hewgley asked him to explain why more room is needed.

 

Moses responded that the BC’s and wet suits don’t fit now and they would like to be able to have gear set up and ready to go in the trailer.

 

Commissioners suggested waiting until the 2017-2018 budget year and trying to get more written bids. They also suggested they look at the storage facility for the dive team trailer to see if a 24 foot trailer would fit in the space.  If so, try to get bids for one or both sizes of trailer.

 

Motion by Hewgley, seconded by Deterding to approve waiving the attorneys’ cost assessed against the Defendants in the following cases before the Lincoln County District Court to wit: The county of Lincoln, Nebraska, vs.  James A. Rivera, et al., Case No. CI 16-33; The county of Lincoln, Nebraska, vs. James A. Rivera, et al., Case No. CI 16-34; and The county of Lincoln, Nebraska, vs. James A. Rivera, et al., Case No. CI 16-36.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to go into a closed session at 10:39 A.M.

concerning strategy sessions regarding pending litigations and to protect attorney client

privilege, which is clearly necessary to protect the public interest. Upon roll call vote

Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Chairman Henry restated the motion for the closed session.

 

Motion by Hewgley, seconded by Deterding to go into open session at 11:27 A.M.

The Lincoln County Board of Commissioners recessed at 12:34 P.M. and reconvened as the Lincoln County Board of Equalization.

Commissioner Hewgley was excused at 2:27 P.M.

The Lincoln County Board of Equalization recessed at 3:32 P.M. and reconvened as the Lincoln County Board of Commissioners.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on June 23, 2017; and was also emailed to the media on June 23, 2017.

 

The agenda for the meetings to be held on Monday, July 1, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
