Emergency meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Chairman Henry called the meeting to order at 10:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Commissioner Hewgley reported that he had spoken with the City of North Platte and they have given the county permission to divert the discharge water. Beveridge Well Drilling was not part of the HVAC project and does not want to be involved in the lawsuit.  Commissioner Hewgley suggested additional wording to the release for any negligent, careless, reckless or intentional act by Beveridge Well Drilling during the rerouting of the discharge line.

 

Motion by Deterding, seconded by Hewgley to approve and authorize Commissioner Joseph Hewgley to sign a release of claims and liability to waive and release Beveridge Well Drilling for any and all claims, liabilities, damage, or suits related to the rerouting of the 3 inch discharge line from the geothermal return line related to the rerouting of the well discharge water in Lincoln County, Nebraska, except for any negligent, careless, reckless, or intentional act by Beveridge Well Drilling during the rerouting of the 3 inch discharge line from the geothermal return line related to the rerouting of the well discharge water in Lincoln County, Nebraska, that causes damage to The county of Lincoln, Nebraska. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The meeting was adjourned at 10:07 A.M.

 

Advance notice and the agenda for the July 5, 2017 emergency board meeting were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 3, 2017; and was also emailed to the media on July 3, 2017.

 

The agenda for the regular meetings to be held on Monday, July 10, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
