Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and Deputy County Clerk, Terry Heessel.  Henry offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 2, 2017.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to receive and order filed the treasurer’s receipts.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve to fee reports submitted by the Register of Deeds and County Sheriff.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the chairman to sign the IBM schedule for ServiceElite Maintenance for Lincoln County.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to authorize the Chairman to sign the legal litigation letter to the County Attorney for audit purposes.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 2, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Hewgley, seconded by Deterding to adopt Resolution 2017-33 setting the 2017 tax levies for all political subdivisions.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

 

Lyle Minshull, Platte Valley Christian Academy Board Member, was present to request a waiver of the 2017 property taxes on the property where the school has been on Rodeo Road.  The school had closed in May of 2016, no teacher was found to continue the school for the 2017-2018 school year.  The property was then put on the market to sell.

The property is sold to a Church.  The property on Rodeo Road has been tax exempt in the past.

 

Board Member, Joe Hewgley, quoted from the Property Tax Exemption Regulations 005.03A “Property which is vacant and unused for any purpose is not entitled to an exemption”.

 

County Assessor, Julie Stenger, clarified that an exemption reaffirmation was mailed to the address on file and was returned undeliverable.  The school was contacted, and told the Assessor’s office that the property was going to be put up for sale, as they had no teacher.  No exemption reaffirmation was received by the Assessor’s office by the deadline of December 31, 2016.

 

The Lincoln County Board of Equalization cannot grant a waiver.

 

The Lincoln County Board of Equalization adjourned at 9:32 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Deterding to set October 30, 2017 at 9:30 A.M. for public hearing as per Neb. Rev. Stat. §13-303 for Lincoln County to provide, establish/re-establish and fund ambulance services in Lincoln County for areas outside the limits of any incorporated city or village in Lincoln County, Nebraska. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

The meeting was adjourned at 10:35 A.M.

 

Advance notice and the agenda for the October 9, 2017 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on October 6, 2017; and was also emailed to the media on October 6, 2017.

 

The agenda for the meetings to be held on Monday, October 16, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
