Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry and County Clerk, Rebecca Rossell. Commissioner Hewgley was absent.  Deterding offered prayer. Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 16 & January 24, 2018. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to approve the appointment of Jeff Higgins to the Lincoln County Safety Committee to finish the term to end in June, 2018. Upon roll call vote Henry and Deterding voted “aye”. Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to place on file the Condition of the Treasury of Lincoln County, Nebraska from July 1, 2017 to December 31, 2017. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2018-04 appointing county depositories for 2018. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to place on file in the office of the Lincoln County Clerk the audit report of Lincoln County, Nebraska for the fiscal year ending June 30, 2017. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to place on file the fee report submitted by the County Sheriff. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign the special designated liquor permit submitted by Pal’s Brewing Company LLC for an event at the Lincoln County Fairgrounds on March 22, 2018. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Henry, seconded by Deterding to approve the late filing of real and personal property exemption application submitted by North Platte Catholic Schools Endowment Trust Inc. on property located at 601 S Tabor, Britton 2nd Replat Lot 1.  Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

The Lincoln County Board of Equalization recessed at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2018-05

to enter The county of Lincoln, Nebraska (Lincoln County), into an interlocal agreement

with The county of Keith, Nebraska, (Keith County), whereby Lincoln County will provide

service to victims of crimes in Keith County through Lincoln County’s Victim Witness

Unit. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley

absent.

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign the special designated liquor permit application submitted by Aden Enterprises for a wedding reception at Harbor Lights on April 21, 2018. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to set February 20, 2018 at 10:00 A.M. for the One & Six Year Road Plan hearing. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

The following bids were received for motor grader blades for the Lincoln County Dept. of Roads: NMC – $16,369.60; and Murphy Tractor – $18,715.00.

Motion by Henry, seconded by Deterding to accept the bid of NMC in the amount of $16,369.60 for motor grader blades for the Lincoln County Dept. of Roads. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

The Lincoln County Highway Supt. received the following informal RFP’s for the South Buffalo Road Project: Baker & Associates, Scottsbluff, NE – $46,200; Mainelli Wagner & Associates, Lincoln, NE – $46,200 and TC Engineering, North Platte, NE – $15,500.  Two other firms contacted did not submit RFP’s for consideration.  The Lincoln County Highway Supt. recommended TC Engineering of North Platte.

 

Motion by Henry, seconded by Deterding to accept the recommendation of the Lincoln County Highway Supt. for TC Engineering of North Platte, NE in the amount of $15,500. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Discussion was held concerning directing the Lincoln County Attorney to file a Complaint for injunctive relief against Ryan Sellers regarding construction of his dwelling in Lincoln County, located in the East half (E1/2) of Section 29, Township 12 North, Range Twenty-Seven (27), West of the Sixth Principal Meridian (6th P.M.), Lincoln County, Nebraska, without attaining a zoning permit from the Lincoln County Zoning Administrator, Judy Clark, as required under the “Zoning Regulations of The county of Lincoln, Nebraska.”  Due to questions concerning an inaccurate legal description no action was taken on this item.

 

The following contracts for brochure distribution for the North Platte/Lincoln County Visitors Bureau were presented: Certified Folder Display Services – $11,343.32 and CTM Media Group – $6,600.

 

Motion by Henry, seconded by Deterding to approve the 2018 contracts for brochure distribution for the North Platte/Lincoln County Visitors Bureau as presented and authorize the Chairman to sign. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to approve a three year (2018-2021) agreement with CBM Managed Services for food service at the Lincoln County Detention Center and authorize the Chairman to sign. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Recess as the Lincoln County Board of Commissioners at 11:00 A.M. and reconvene as the Lincoln County Board of Equalization.

 

Motion by Henry, seconded by Deterding to go into closed session at 11:01 A.M. concerning strategy session regarding pending litigations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Henry, seconded by Deterding to go into open session at 11:24 A.M. Upon roll call vote Henry and Deterding voted “aye”.  Nays, none.  Hewgley absent.

 

Adjourn as the Lincoln County Board of Equalization at 11:24 A.M. and reconvene as the Lincoln County Board of Commissioners.

Advance notice and the agenda for the January 29, 2018 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on January 26, 2018; and was also emailed to the media on January 26, 2018.

 

The agenda for the meetings to be held on Monday, February 5, 2018 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
