Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and Deputy County Clerk Terry Heessel.  Hewgley offered

prayer.  Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners on June 18, 2018.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to receive and ordered filed the treasurer’s receipts.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to sign the Right of Way Certificate for Federal Aid, Recreational Trails Program Project.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to authorize Chairman to sign the lease/purchase agreement with Caterpillar Financial Services Corp on the compact truck loader for the Lincoln County Department of Roads.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to accept the resignation of Michelle Gurciullo on the Security Committee as of June 29, 2018.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to accept the appointment of Darla Morris to the Security Committee.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:20 A.M. and the Lincoln County Board of Equalization convened.

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 18, 2018.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Julie Stenger, Lincoln County Assessor, was present.

 

There were no corrections and refund submitted by the County Assessor.

 

Motion by Henry, seconded by Hewgley to approve the Notice of Valuation change 2018-011 to as submitted by the County Assessor.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The County Board of Equalization recessed to time certain at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The Petition for Preservation and Maintenance of Pleasant Valley Cemetery was presented to the County Board.   Denny Harrahill expressed his personal interest in the cemetery as family is there.  He stated that it is in dire need of maintenance.  County Commissioner Bill Henry has also visited this cemetery and commented that it is in bad shape.

 

Motion by Hewgley, seconded by Henry to direct the County Attorney or one of her representative’s type a Resolution, regarding continuous preservation and maintenance of the cemetery, for the board to consider at its next meeting.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Amy Herrick of the Lincoln County Ag Society was present (by Phone) to answer questions about the applications for Special Designated Liquor Licenses.

 

Motion by Henry, seconded by Hewgley to approve the special designed liquor license applications submitted for the Lincoln County Fair Dance/Beer Garden on July 27, 2018 and the Lincoln County Fair Slick Pig Contest on July 28, 2018 to be held at the Lincoln County Fairgrounds Pavilion and Grandstands.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to approve the agreement with Martin Troshynski to be the conflict attorney in matters where he would represent individuals who are indigent and entitled to representation in which he is court appointed to represent such individuals in criminal matters, juvenile matters and subsections 1,2,3a & 3b of NE Rev. Stat §43-247, mental health proceedings, and child support contempt and paternity cases and authorize the Chairman to sign.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to approve the agreement with William Troshynski for legal services in guardianship and conservatorship matters and authorize Chairman to sign.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to go into closed session at 10:05 A.M.  regarding litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

Chairman Deterding restated the reason for the closed session.

 

Motion by Henry, seconded by Hewgley to go into open session at 10:25 A.M.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Mr. Philip Black of Congressman Smith’s office called to state he will not be able to attend the meeting and will reschedule.

Advance notice and the agenda for the June 25, 2018 board meetings were sent to members of the county board, county attorney and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County Website on June 22, 2018; and was also emailed to the media on June 22, 2018.

 

The agenda for the meetings to be held on Monday, July 2, 2018 will be continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
