Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on September 4, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to receive and order filed the fee report submitted by the County Clerk. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to approve and authorize the Chairman to sign the Adoption of Agreement for First Concord Benefits to amend the Lincoln County flexible benefits plan to add the cash-in-lieu option. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to approve and adopt Resolution No. 2018-19 to amend the Lincoln County flexible benefits plan effective July 1, 2018 to add the cash-in-lieu program. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on September 4, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

 

Motion by Henry, seconded by Hewgley to deny the appeal for the notice of homestead exemption rejection submitted by Ronald Schroeder. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to approve the confession of judgment regarding the case of Stephanie Simpson Revocable Living, Stephanie Simpson, Trustee, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 18R 0024, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses in and herein motion that the value of the real estate, in the aforementioned case (Case No. 18R 0024), should be $445,360.00 (Land – $73,950.00 and Improvements – $371,410.00) for tax year 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:28 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Henry to approve exceeding the budget limit by an additional one percent (1%) for the 2018 /2019 fiscal year Lincoln County, NE budget if needed. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to set September 17, 2018 at 10:00 A.M. for public hearing to receive comments on the proposed 2018/2019 fiscal year Lincoln County, NE budget. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to set September 17, 2018 at 10:15 A.M. for public hearing for the purpose of receiving comments relating to setting the final tax request for a different amount than the prior year. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

County Board conducted a work session to discuss Franchise Agreement negotiations with Charter Communications and give direction to the Lincoln County Attorney or her deputies on the matter.

 

Motion by Hewgley, seconded by Henry to go into closed session at 9:53 A.M. concerning strategy session regarding negotiations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Hewgley, seconded by Henry to go into open session at 10:30 A.M. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

County Board conducted a brief 2018/2019 budget work session.

Advance notice and the agenda for the September 10, 2018 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on September 7, 2018; and was also emailed to the media on September 7, 2018.

 

The agenda for the meetings to be held on Monday, September 17, 2018 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
