Meeting of the Lincoln County Board of Commissioners. Present were Commissioners  Joe Hewgley, Kent Weems, Bill Henry, Walt Johnson, Jerry Woodruff, and Deputy County Clerk, Terry Heessel.  Johnson offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 14, 2019.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Weems to receive and order filed the treasurer’s receipts.  Upon roll call vote Henry, Weems, Johnson, Woodruff, and Hewgley voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Henry to receive and order filed fee report submitted by the County Sheriff.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Weems to enter into and authorize Chairman to sign  the amended agreement on Accounting Procedure Report of Lincoln County Treasurer’s office with Don Wilson CPA.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Henry to adopt Resolution 2019-03 to amend Resolution 2011-06 to change authority over department heads to the Chairman and one Commissioner.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:30 A.M. and the Lincoln County Board of Equalization convened.

Motion by Henry, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 14, 2019. Upon roll call vote Henry, Weems, Johnson, Woodruff, and Hewgley voted “aye”.  Nays, none.

 

County Assessor, Julie Stenger, was present.

 

No certificates of correction and refund were submitted by the County Assessor.

County Assessor, Julie Stenger and County Appraisers, Charity Farley and Henry Vogt were present to discuss rent-restricted housing projects Parkland Estates II, L.P. and Luke Estates, L.P.

 

Received and accepted Exhibits 1-4 to show the income-approach calculation does not result in a valuation of the Parkland Estates II, L.P., (10 Units), rent restricted housing project, at actual value.

 

Motion by Henry, seconded by Weems to concur with the Assessor and direct the Lincoln County Attorney to have her or one of her deputies draft a Petition to be filed with the Nebraska Tax Equalization and Review Commission to utilize another professionally accepted mass appraisal technique on Parkland Estates II, L.P.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Received and accepted Exhibits 1-4 to show the income-approach calculation does not result in a valuation of the Luke Estates, L.P. (10 Units), rent restricted housing project at actual value.

The Lincoln County Board of Equalization adjourned at 9:56 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Henry, seconded by Weems to go into closed session at 9:58 A.M. concerning strategy session regarding pending litigations and to protect attorney client privilege which is clearly necessary to protect the public interest.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley restated the reason for the closed session.

 

Motion by Henry, seconded by Weems to go into open session at 10:28 A.M.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Lee Davies, Architect, presented the final design plans for the bathrooms on the first floor of the courthouse.  The budget for renovations will be between $275,000 and $325,000, as per Mr. Davies.

 

Joe Wright, Lincoln County Deputy Attorney, reviewed the changes made to the Franchise Agreement Negotiations with Charter Communications.  The County Board directed the County Attorney or her deputies to continue with the agreement.

 

Motion by Weems, seconded by Johnson to appoint Bill Henry and Jerry Woodruff to oversee building and grounds department.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Weems to adopt Resolution 2019-02 to authorize the Chairman to sign an Interlocal agreement to house inmates at the Lincoln County Detention Center for Merrick County.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Sheriff Jerome Kramer and Chief Deputy Roland Kramer presented the yearend report for the Detention Center.

 

Motion by Henry, seconded by Woodruff to set the date of February 11, 2019 at 10:00 A.M. to receive bids on 3 pickups for the Lincoln County Sheriff’s Department.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Henry to go into closed session at 11:24 A.M.  regarding deployment of security personnel or devices and to protect attorney client privilege, which is clearly necessary to protect the public interest.  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley restated the reason for closed session.

 

Motion by Johnson, seconded by Weems to go into open session at 11:42 A.M..  Upon roll call vote Henry, Weems, Johnson, Woodruff and Hewgley voted “aye”.  Nays, none.

 

Approved the claims as presented for payment.

 

The meeting was adjourned at 12:05 P.M.

 

Advance notice and the agenda for the January 22, 2019 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on January 18, 2019; and was also emailed to the media on January 18, 2019.

 

The agenda for the meetings to be held on Monday, January 28, 2019 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
