Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Hewgley offered prayer. Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 7, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Woodruff to receive and order filed the fee reports submitted by the County Clerk, Register of Deeds and County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Henry, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 14, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Henry to approve notice of valuation change numbered 2019-44 as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Weems to approve and adopt Resolution No. 2019-32 setting the 2019 tax levies for all political subdivisions headquartered in Lincoln County. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.
Planning Director, Judy Clark, appeared on two planning applications submitted for consideration. Planning staff had no objections to either application.
Motion by Henry, seconded by Weems to approve the application by Kent and Jacqueline Allison for Rolling Hills 2nd Administrative Subdivision located at 3523 North Meadowlark Lane described as Lots 6 & 7, Rolling Hills Estates Second Subdivision of part of Section 19; Township 14 North; Range 29 West of the 6th P.M., Lincoln County, Nebraska which will consolidate the lots. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
No action was taken on the application by Jeffrey Canyon Ranch, LLC for Jeffrey Lake
Administrative Subdivision located at Jeffrey Lake described as a tract of land in the S ½ of Section 9; Township 11 North, Range 27 West of the 6th P.M., Lincoln County, Nebraska. The application is for a public dump site and the County Board had questions concerning what would be dumped at the site as well as how it would be contained. Judy Clark will have the applicant do a site plan and will put it back on the agenda for consideration. Board asked that the applicant also appear.
Motion by Bill, seconded by Kent to accept the bid for 3 new dump trucks for the Lincoln County Department of Roads from Nebraska Truck Center: 2021 15’ Warren FL Series trucks priced at $118,487 each, less trade in allowance of $12,000 and adding the engine brake option for a total of $347,931 for three dump trucks. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Nebraska Public Power District had an update on the construction on R-Project Transmission Line. County Board requested a site map of all staging sites and county roads that will be used during construction.
The following bids were received for grader blades for the Lincoln County Department of
Roads: NMC: $20,058.80 and Murphy Tractor & Equipment Company – $26,890
Motion by Henry, seconded by Weems to accept the bid of NMC in the amount of $20,058.80 for grader blades for the Lincoln County Department of Roads. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye’. Nays, none.
Motion by Henry, seconded by Weems to set November 4, 2019 at 10:00 A.M. to accept bids for a new/used dozer for the Lincoln County Department of Roads. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Carla O’Dell, Lincoln County Highway Superintendent, presented the annual report for the road department. She commented that she will continue to do the report for the County Board but it is no longer required to be submitted to Nebraska Dept. of Transportation.
Paul Grieger of D.A. Davidson was present to discuss a resolution authorizing the issuance of Limited Tax County Building Bonds in an amount not to exceed $4,700,000 for the purpose of paying the costs of constructing additions and improvement to the county law enforcement building.
County Board members took no action as they wished to address several possible concerns before adopting the resolution.
Commissioner Henry was excused at 11:00 A.M.
Discussion was held concerning identifying and retaining a qualified representative for Lincoln County to act on its behalf with respect to the jail expansion, specifically the review of drawings, plans, instruments, architectural renderings, and to provide on-site
representation of Lincoln County during all phases of construction.
Commissioner Weems stated he does not want a repeat of all the problems that occurred during the construction of the Sheriff’s Office and Detention Center. He would like to see someone retained to be on the job every day to represent the county and be part of the project. Commissioner Weems asked if a request for proposal would be put out for additional services to protect the county’s interest in the project.
Joe Hewgley, as an individual, stated that a request for proposal and a request for qualifications could be put for obtaining this person.
Commissioner Weems responded that as County Board Chairman he was hoping that Hewgley would give the board direction without making it complicated. Commissioner Weems expressed that he felt Commissioner Hewgley should participate in the project as a County Commissioner and not on the architectural side with his own personal business.
Deputy County Attorney, Tyler Volkmer, stated that the AIA contract requires a county representative. Two different individuals may be required for different stages of the project. This would give the county a qualified expert to testify to standards should that be necessary.
Joe Hewgley commented that it is difficult to find a person in this area to be a qualified representative. It is usually a key person not an expert. Hewgley stated he may have a potential conflict of interest if he works with the architect.
Deputy County Attorney, Joe Wright, reported that Hewgley could declare a conflict of interest. If he chooses to do that he then cannot be involved in the detention center project from the County’s side.
No action was taken on a qualified representative(s).
Joe Hewgley, as an individual, said he and Treanor have discussed his possible service as a subcontracting architect to keep an eye on construction. Treanor approached him because of being local and his past experience with the jail. The contract is the same contract that was used last time. A letter has been included stating what the role of Hewgley Architecture would be in the project.
Deputy County Attorney, Joe Wright, told County Board members that the AIA contract is not ready to be signed as they are still reviewing it.
Joe Hewgley stated again that his firm would be working for Treanor and a personal representative would be looking out for the county’s best interests.
Commissioner Woodruff asked if the contract would spell all these concerns out.
Commissioner Weems commented that the county has a board member that could provide this service and that he does not support Commissioner Hewgley’s personal involvement in the project.
Joe Hewgley told them to make the contract as stringent as they wanted and to make the contract to the county’s advantage.
No action was taken on the AIA agreement between The county of Lincoln, Nebraska and TreanorHL, Inc. for the detention center addition and remodel project.
No action was taken on entering The county of Lincoln, Nebraska, into an acquisition
contract with CHAR-MAR-LONG, LIMITED PARTNERSHIP, to acquire a permanent
easement in approximately 5.14 acres, located on the North Half (1/2) of Section 7,
Township Thirteen (13), North, Range 30 West of the 6th P. M., Lincoln County,
Nebraska, for the purpose of rebuilding a section of the West South River Road.
No action was taken on accepting a donation of a temporary easement from CHAR-MAR-LONG, LIMITED PARTENERSHIP, which is in approximately 0.07 acres, located on the North Half (1/2) of Section 7, Township Thirteen (13), North, Range 30 West of the 6th P. M., Lincoln County, Nebraska, for the purpose of rebuilding a section of the West South River Road.
