Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Hewgley offered prayer. Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Johnson, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 27, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to approve and authorize the Chairman to sign the resubmission of the special designated liquor license by US Chamber of Commerce DBA North Platte Jaycee’s for a fundraiser on March 7, 2020 at the Lincoln County Fairgrounds Livestock Barn to clarify the legal name of the organization. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
County Assessor, Julie Stenger appeared.
Motion by Weems, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 27, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real estate. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to approve the request for waiver submitted by Apostolic Worship Center and International Church of the Foursquare Gospel aka The Rock Church so that the County Assessor can consider the application for exemption on real or personal property due to late filing. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.
Commissioner Hewgley did not participate in the detention center project agenda item due to a conflict of interest.
Dan Rowe of TreanorHL made a video presentation to the County Board on the Schematic Design for the renovation and expansion of the Lincoln County Detention Center.
Various items on the schematic design were discussed by the architect, County Board, County Sheriff and Tom Werblow of T C Engineering, who is the contracted county representative for the County Board on preliminary design.
Cost estimates for project are at 4.3 million for construction with total project cost of 5.1 million.
Commissioner Woodruff asked about the precast cells versus the prefabricated modular units.
Rowe responded that there are only 2 or 3 manufacturers now that can supply the precast cells. When the original project was constructed there were more manufacturers and the supplier used was close in proximity. The new project is right on the border line for economics for the precast cells.
Commissioner Woodruff questioned if it would help to have early bid package to allow time for the precast cells which would be the preference.
Rowe replied yes but there is still time.
Commissioner Woodruff wanted information on the professional fees.
The professional fees are for TreanorHL and were cut from 10% down to 9.5%.
Commissioner Weems stated one of his early concerns was the power grid having enough service capacity with the new addition.
Tom Werblow reported in terms of load it would need to be calculated.
Rowe responded that they are not expecting changes in the service. The preliminary calculations indicated there should be enough power for the expansion.
Packets will be provided to the County Board for review prior to approval of the schematic design.
Rowe stated the project time table is in a good bid environment. They are looking at June or July bids. They will need 5 to 6 weeks for design development.
Joe Hewgley, acting as a citizen, stated he was hoping the board could approve the schematics today as they want to get back on the original schedule.
Dan Rowe replied that if it is not signed until next week it should have no effect on the time table for bidding. They will continue to work on the project.
Motion by Weems, seconded by Woodruff to tentatively accept and review over the next week for formal approval the Schematic design by TreanorHL for the renovation and addition of the Lincoln County Detention Center. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. No vote for Hewgley due to conflict of interest.
Motion by Woodruff, seconded by Johnson to declare the county’s surplus mobile
equipment (scrap pickup trucks) in the Lincoln County Department of Roads to be
surplus property, which is obsolete or unusable by the County. Upon roll call vote
Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to place a value of $640 on the surplus property (scrap pickup trucks) located at the Lincoln County Department of Roads. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to authorize Carla O’Dell, Lincoln County Highway Supt. to sell the surplus property (scrap pickup trucks) to Alter Metals for $640 contingent on the total value of the surplus property (scrap pickup trucks) being under $5000. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to declare the county’s surplus mobile equipment (1966 CAT motor-grader with Roanoke Mower) in the Lincoln County Department of Roads to be surplus property, which is obsolete or unusable by the county. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to place a value of $4700 on the surplus property (1966 CAT motor-Grader with Roanoke Mower) located at the Lincoln County Department of Roads. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to approve authorizing the sale of the surplus mobile equipment (1966 CAT motor-grader with Roanoke Mower), with a value of less than $5000, which is obsolete or unusable by the County, by means (ways) allowed under Neb. Rev. Stat. §23-3115 and authorize Carla O’Dell, Lincoln County Highway Supt., to list the item with Purple Wave Auction to be sold. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Woodruff to set February 24, 2020 at 10:00 A.M. for the One & Six Year Road Plan. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems to set February 24, 2020 at 9:30 A.M. to receive bids on up to four pickup trucks for the Lincoln County Sheriff’s Office with trade-ins. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Planning Director, Judy Clark, reported that she had received complaints from neighbors on a mobile home located on the property owned by Katherine Victoria Harper. Two letters had been sent to Ms. Harper and the Planning Department had received no response. A mobile home is not allowed in this area per Zoning Regulations.
Harper replied that she did not know that an amendment was needed. She plans to use it as a storage shed and is trying to get it sided so it will match the house. She had not responded due to personal reasons.
Clark stated Planning staff would work with her to come into compliance.
Motion by Hewgley, seconded by Weems to authorize Judy Clark, Lincoln County Planning Director, to work with Ms. Harper to come to a resolution and provide an update back to the County Board. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chase Dodson, property manager and Attorney Brock Wurl appeared to represent Char-Long-Mar Partnership concerning the fencing agreement with Lincoln County for the South River Road Re-construction project.
Commissioner Woodruff reported that there might be a misunderstanding on what appears in the contract and what the landowners understood in regards to what the fence looks like and the length of the fence.
Wurl cited what he believed to be what was negotiated concerning the movement of the fence. The fence would be moved to the Southern border of the County right-of-way the entire length of South River Road.
Commissioner Hewgley, who did the negotiations on behalf of the county, concurred with what Mr. Wurl had stated.
Commissioner Woodruff asked about extending the fence for an extra 100’ so it would be continuous and match the other fence. The two wire gates would be re-used. It would be a 4 wire fence constructed to legal description. He also recommended that the county provide driveways from the new county road to the property with culverts. In case the fence was not moved in time for grazing season the county may have to consider electric fence as a contingency plan.
Dodson replied that the current contract for grazing would begin either May 1 or May 15.
Deputy County Attorney, Tyler Volkmer, stated that the contract needs to be amended for clarification so it will all be in writing.
Motion by Weems, seconded by Hewgley to adopt any and all modifications to the original fencing agreement with Char-Long-Mar Partnership on South River Road in writing, make additions as necessary and have appropriate parties sign off. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
A motion was made by Woodruff, and seconded by Hewgley to add to the fence replacement project on South River Road two access points off of the county road to the property with culverts.
Commissioner Hewgley asked Lincoln County Highway Supt., Carla O’Dell to cite the county’s policy on culverts.
Commissioner Hewgley stated this particular item would not comply with county policy.
Discussion was held concerning if the culverts would really be necessary or beneficial.
Dodson stated he felt it would be in the county’s best interest to put in culverts to keep the road in better condition. It would be better to use access points rather than driving thru the ditch.
Assistant Highway Supt., Brian Glos, commented that the borrow is limited and that most of the material will need to be hauled in.
Commissioner Johnson interjected that if there is no borrow then culverts probably are not needed.
A motion was made by Woodruff and seconded by Johnson to amend the previous motion stating that at the time of road construction, at that point in time, at the discretion of the County Road Department, when access is put in those two spots a culvert will be put in if needed, if not we would not put a culvert in but there will be access into the field at two locations. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Roll call vote was then taken on the original motion as amended. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Planning Director, Judy Clark, supplied the County Board members with a copy of the proposed amendments to the zoning regulations on Sections 8.07 and 8.08 of Article 8 showing exactly what was being added and deleted from the original content.
Chairman Henry accepted the documents and asked that it be marked as “Exhibit 2”.
Motion by Hewgley, seconded by Weems to accept “Exhibit 2” as presented. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
