Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Henry offered prayer. Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on March 2, 2020. Upon roll call vote Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none. Hewgley abstained.
Motion by Weems, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to receive and order filed the fee reports submitted by Clerk of District Court, Register of Deeds and County Clerk. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Hewgley, seconded by Weems, to authorize the Chairman to sign the right of way application submitted by Nebraskalink Holdings. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Woodruff to authorize the Chairman to sign the right of way application submitted by Consolidated Companies Inc. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to authorize the Chairman to sign the rental contract with Microfilm Imaging Systems for a printer located in the County Attorney’s Office. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Weems, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on March 2, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.
Motion by Johnson, seconded by Weems to set the value of $300 on the surplus
personal property (large conference table stored on the 4th floor of the Lincoln County
Courthouse). Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted
“aye”. Nays, none.
Motion by Johnson, seconded by Woodruff to authorize Jeff Higgins, Building & Grounds Superintendent for Lincoln County, to sell the personal property (large conference table stored on the 4th floor of the Lincoln County Courthouse) to Aten Construction for $300.00. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Commissioner Woodruff and Hwy Supt. Carla O’Dell recommended to the County Board to accept the informal bid of Walker Stewart for fencing on the South River Road Reconstruction Project.
Motion by Woodruff, seconded by Johnson to accept the informal bid for fencing on the South River Road Reconstruction Project by Walker Stewart in the amount of $10,265.00 for Phase I and II. If needed, Phase III for $1800.00. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none,
Two informal bids were received for a construction engineer for the O’Fallen TIA bridge project as follows: Mainelli Wagner & Assoc. – $8800; Oak Creek Engineering – $9300.
Motion by Johnson, seconded by Hewgley to accept the informal bid for a construction engineer for the O’Fallen TIA bridge project of Mainelli Wagner & Assoc. in the amount of $8800.
Motion by Weems, seconded by Woodruff to amend the motion to specify they are also authorizing the Chairman to sign the letter from Mainelli Wagner & Assoc. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to approve the motion as amended. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Shari Cecil, representing the Lincoln County Ag Society appeared to answer questions about the special designated liquor permit they are requesting. They must be 21 or over to attend. They must have a designated driver. There will be people posted at all the gates. Those participating will have wristbands. The area being covered is the whole area of the fairgrounds.
Sheriff Kramer had some concerns about the large land area they will need to police. Would like to see the Jaycees help with volunteers.
Cecil said she would reach out to them for additional volunteers.
Motion by Woodruff, seconded by Hewgley to approve and authorize the Chairman to sign the special designated liquor permit submitted by the Lincoln County Ag Society for a fundraiser to be held on April 4, 2020 at the Lincoln County Fairgrounds. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Hwy Supt., Carla O’Dell, gave a recap of the 2109 projects that had been completed. She then presented the 2020 One & Six Year Road Plan.
The public hearing on the One & Six Year Road Plan was opened at 10:18 A.M.
Micheal Koch requested the Eugene Ave. be moved from the Six Year Plan to the One Year Plan due to the high volume of truck traffic on the road.
Charlie Williams, representing the Village of Wallace, thanked the road department for considering roads down in that area on the plan.
Larry Siger commented that the Morning View Cemetery road is on the One Year Plan and he is very appreciative.
Michael Koch asked a question concerning subdivision roads that had been raised at last year’s One & Six Year Road Plan hearing.
Commissioner Hewgley stated that it had been the county’s policy for a large number of years to not accept any “new” subdivision roads. The ones listed in the road plan were previously accepted.
David Anderson reported that Morning View Road is not in good shape. He would like to see the work on the road done as soon as possible as it will have quite a bit of traffic through Labor Day with the cemetery.
The public hearing was closed at 10:30 A.M.
Commissioner Hewgley thanked the road department for their work and Commissioner Woodruff concurred.
Commissioner Weems asked about the possibility of putting weight restrictions on Eugene Avenue.
O’Dell agreed that it is to narrow, concrete is breaking up and it does need to be widened. She commented that weight restrictions might mitigate some of the truck traffic.
Board discussed Cattle Growers Road and some of the new mix that was used as a trial on a portion of the road. Culverts and pulling up the ditches was part of the discussion on this road as well as crowning the road. It was suggested that limestone might also work in place of the granite.
Board then asked about any plans for Autogate Road.
O’Dell replied that only maintenance is planned. Brian Glos, Assistant Highway Supt., said it had moved up on his list for improvement.
Board then asked when the overlay project might resume.
O’Dell responded that she would like to resume on April 1st depending on weather.
O’Dell then brought the board up to date on the South River Road Reconstruction project.
Motion by Hewgley, seconded by Weems to approve and adopt the One & Six Year Road Plan as presented. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Hewgley to approve and authorize the Chairman to sign the agreement with The Schemmer Associates Inc. for courthouse mechanical and geothermal analysis consulting services on behalf of the client, initiate the agreement as written, limited to the scope as written. Upon roll call vote Hewgley, Weems, Henry,
Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to settle with Bryce L. Franzen in regards to
the guardian ad litem fees due and owing to “The county of Lincoln” by Bryce L.
Franzen, Case No. CI 00-158, In the District Court of Lincoln County, Nebraska in the
amount of $1551.14. With the clearance of the check it will be a closed matter. Upon
roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to go into closed session at 11:22 A.M. to
discuss strategy session with respect to pending litigations and to protect attorney client
privilege, which is clearly necessary for the protection of the public interest. Upon roll
call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Henry restated the motion for the closed session.
Motion by Woodruff, seconded by Johnson to go back into open session at 11:37 A.M.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on March 6, 2020; and was also emailed to the media on March 6, 2020.
The agenda for the meetings to be held on Monday, March 16, 2020 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
