Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Johnson offered prayer. Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on June 1, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Johnson to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Woodruff to receive and order filed the fee reports submitted by the County Sheriff, County Clerk and Register of Deeds. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign the interlocal agreement with the City of North Platte for fuel services from July 1, 2020 to June 30, 2021. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Weems to authorize the Chairman to sign the Federal Excise Tax Return for PCORI fees. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 1, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:16 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Kim Kelley appeared on the SDLOP submitted by La Casa Del Rios LLC for a horse sale at North Platte Stockyards. She reported they would have security and would be using the wristbands.

 

Sheriff Kramer requested that the pens not be included in the area for the liquor permit.

 

Motion by Weems, seconded by Johnson to approve and authorize the Chairman to sign the Special Designated Liquor Permit submitted by La Casa Del Rios LLC for a horse sale on June 20, 2020 at North Platte Stockyards with the condition that the diagram of the proposed area be modified to limit the area of possession/consumption and is approved by Lincoln County Sheriff, Jerome Kramer.

 

Commissioner Hewgley clarified that the approval is based on the condition that the area to be included is approved by the County Sheriff. Also that the County Board is only acting on the liquor permit and not any other restrictions due to other factors.

 

Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Johnson to appoint Brandon Myers, Region 51 Emergency Management Director, to be the point person for the Nebraska COVID -19 Local Government Response Assistance program application. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Chairman Henry stated the situation had been resolved concerning the bull riding event to be held on June 12 & 13, 2020 at North Platte Livestock Auction. West Central District Health Department wants to make a change and have one County Commissioner from each county to be part of the Command Center.

 

Commissioner Hewgley stated that it is not the county’s roll to police the health measures.

 

Sheriff Kramer reported that the Sheriff’s Office would handle the tort claim filed by Patrick Horton.

 

Motion by Woodruff, seconded by Weems to table the tort claim filed by Patrick Horton.

Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, second by Hewgley to go into closed session at 10:10 A.M. concerning strategy session regarding pending litigation and imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Chairman Henry restated the motion for the closed session.

 

Motion by Woodruff, seconded by Johnson to go into open session at 10:34 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Advance notice and the agenda for the June 8, 2020 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on June 5, 2020; and was also emailed to the media on June 5, 2020.

 

The agenda for the meetings to be held on Monday, June 15, 2020 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
