Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Bill Henry, Kent Weems, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell. Henry offered prayer. Weems called the meeting to order at 9:00 A.M. Commissioner Hewgley was absent.
Chairman Weems announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Henry, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 1, 2021. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
Motion by Woodruff, seconded by Bruns to receive and order filed the treasurer’s receipts. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
Motion by Henry, seconded by Bruns to adopt Resolution No, 2021-07 appointing county depositories for 2021. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
Motion by Bruns, seconded by Woodruff to receive and order filed the fee reports submitted by the Register of Deeds, County Clerk and Clerk of District Court. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye’. Nays, none. Hewgley absent.
Motion by Woodruff, seconded by Bruns to authorize the Chairman to sign the 2021-2025 Electronic Registration System agreement with the State of Nebraska, Vital Records Section. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Henry, seconded by Bruns to authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
Motion by Woodruff, seconded by Bruns to authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.
County Attorney, Rebecca Harling, asked the County Board for permission to negotiate with the University of Nebraska Medical Center on claims from June, 2020 for James Mitchell. The billing department has been contacting Rebecca and suggested that she submit a payment proposal. Rebecca has also spoken with the county’s insurance carrier and will work with them as well. There is $55,741.97 due to UNMC Physicians and $289,437.27 due the Medical Center.
Motion by Bruns, seconded by Henry to authorize the County Attorney’s Office to negotiate with UNMC on claims for James Mitchell. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
Noxious Weed Supt., Todd Herndon, reported that it is getting harder to hire weed sprayers at $10.00 per hour. He is requesting the starting wage to be adjusted to $12.00 per hour. These individuals then have 90 days to get pesticide licensing. After each license is obtained they receive a pay increase. He is looking for three sprayers and will hopefully be able to move one to a full time position in the fall.
Commissioner Weems asked if pay range guidance would be adequate. Todd could then evaluate performance. Herndon replied yes.
Commissioners discussed the need for competent employees due to liability involved in weed spraying.
Motion by Henry, seconded by Woodruff to allow the Noxious Weed Supt. to set the minimum wage for weed sprayers at $13.00 per hour and at his discretion move up to $15.00 per hour. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye’. Nays, none. Hewgley absent.
The following bids were received for a tractor for the Lincoln County Department of Roads: North Platte Kubota – 2021 – $65,434.65; Titan Machinery – 2017- $109,800.00.
No action was taken, to allow Road Dept. personnel to review bids.
The following bids were received for a single flex-wing mower for the Lincoln County Department of Roads: North Platte Kubota- 2021 – $17,759.50; Titan Machinery – 2021 – $20,475.00.

Motion by Woodruff, seconded by Bruns to go into closed session at 10:18 A.M. concerning strategy session regarding pending litigation and to protect attorney, client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Weems, Henry, Bruns and Woodruff voted “aye”. Nays, none. Hewgley absent.
Chairman Weems restated the motion for the closed session.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on February 5, 2021; and was also emailed to the media on February 5, 2021.
The agenda for the meetings to be held on Tuesday, February 16, 2021 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.
