Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Kent Weems, Micaela Wuehler, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell. Bruns offered prayer. Bruns called the meeting to order at 9:00 A.M.
Chairman Bruns announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 25, 2022. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
The interlocal agreement with Keith County to house inmates at the Lincoln County Detention Center was tabled.
Motion by Woodruff, seconded by Wuehler to authorize the Chairman to sign the right of way application submitted by Great Plains Communications. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

No certificates of correction or refund submitted by the County Assessor.
Motion by Hewgley, seconded by Woodruff to approve the late filing of homestead exemption application submitted by Charles Morgan as he was not late last year. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
Adjourn at 9:18 A.M. as the Lincoln County Board of Equalization and reconvene as the Lincoln County Board of Commissioners.
Motion by Hewgley, seconded by Wuehler to authorize the Chairman to sign special designated liquor application submitted by Pals Brewing Company for the Western Nebraska Craft Beer Festival to be held on September 10, 2022, at Pals Brewing Company. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.
County Assessor, Julie Stenger, along with lead appraiser, Charity Farley, presented the Three-Year Plan of Assessment Update for Lincoln County 2022.
Discussed the request of Art Hasenauer (Hasenauer Acre LLC) concerning the
small triangle piece of property on S Somerset Road that the state abandoned
to the county. This piece of property used to be part of State Highway 23. In 1947, it became a county road named Somerset. It is still deeded to the State of Nebraska, but it has been turned over to the county. The LLC would like to purchase the small piece so they can construct fencing. They have actually paid taxes on this tiny parcel from 1947 to 2017.
Commissioner Wuehler confirmed that the deed does still say the State of Nebraska. It is approximately a ½ acre of land. The state vacated it back in 1955 and by state statute it goes back to county ownership.
Deputy County Attorney, Tyler Volkmer, reported that the state statute (39-1722) there is a process that allows the county to vacate the parcel by resolution.
The County Board directed the Highway Supt. to do a study and report back to the County Board.
Discussion was held on the Lincoln County Black-Tailed Prairie Dog Management Plan drafted by Volkmer.
He asked if the County Board wanted to have an advisory committee to receive and investigate reports or report to the County Board or a sub-committee of the County Board.
The Noxious Weed Supt. in other counties are involved in reporting prairie dog issues as they see them in the county while spraying.
Commissioner Wuehler reported that the Lincoln County Noxious Weed Supt. already has a list of properties that have prairie dog issues.
Volkmer stated that there is a general legal notice that would have to be done letting property owners know they have to manage the prairie dogs on their property.
Commissioner Woodruff asked about extra compensation for the Noxious Weed Supt. for the additional duties. He wants residents of the county to know who to contact if they have something to report.
Wayne Rundback spoke about a neighboring property that has a prairie dog issue and the problems that it is creating for him on his property.
Commissioner Weems feels a management plan would be a good place to start.
Board members felt that the noxious weed and road department personnel would be able to report prairie dog issues as well as the USDA wildlife specialists.
Commissioner Bruns clarified that the cost of control would be on the property owner, by special assessment, if necessary.
Commissioner Wuehler commented that a timed response in the plan would be a good addition.
Planning Director, Judy Clark, appeared to discuss an interlocal agreement with the City of North Platte to apply for CDBG Planning Grant for Comprehensive Plan Housing Update AHAP and Safe Streets. She reported that if the city and county apply jointly, they are eligible for more grant funding. It is helpful if the city and county to work together particularly in the two-mile zoning radius. The city and county will each have their own final comprehensive plan. The county would need to budget for 50% of the grant match. The City of North Platte will be the pass through for the grant funding.
Motion by Woodruff, seconded by Weems to enter into an interlocal agreement with the City of North Platte to apply for CDBG Planning Grant for Comprehensive Plan Housing Update AHAP and Safe Streets. Upon roll call vote Hewgley, Weems, Wuehler, Bruns and Woodruff voted “aye”. Nays, none.

The agenda for the meetings to be held on Monday, August 8, 2022, will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
