Meeting of the Lincoln County Board of Commissioners. Present were Commissioners

Joe Hewgley, Willis Roethemeyer, Duane Deterding, Board Assistant, Tammy White,

Deputy County Attorney, Joe Wright and County Clerk, Rebecca Rossell. Deterding

offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for

public review and the County Board will comply with the open meeting requirements.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the

Lincoln County Board of Commissioners meeting held on June 28, 2010. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the

treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted

“aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the fee

reports submitted by the County Sheriff, County Clerk and County Court. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln

County Board of Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Assessor Long was present.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the

Lincoln County Board of Equalization meeting held on June 28, 2010. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

There were no certificates of correction and refund submitted.

Motion by Deterding, seconded by Roethemeyer to approve the notice of valuation

changes numbered 2010-134 thru 2010-177 as submitted by the County Assessor.

Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization recessed at 9:20 A.M. and the Lincoln County

Board of Commissioners reconvened.

Motion by Deterding, seconded by Roethemeyer to appoint Lee F. Hoatson to the

Veterans Service Committee for a 2 year term beginning July 6, 2010 and ending June

30, 2012. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,

none.

Discussed general assistance appeal filed by Gwendolyn Johnson.

Commissioner Hewgley requested that the on-line case history for Gwendolyn Johnson

supplied by HHS be marked as Exhibit #5. No objections were made concerning the

information being marked as Exhibit #5.

Commissioner Hewgley asked that we go into closed session to protect the reputation

of an individual.

Johnson nodded in the affirmative to go into closed session.

Motion by Deterding, seconded by Roethemeyer to go into closed session at 9:34 A.M.

to protect the reputation of an individual. Upon roll call vote Deterding, Roethemeyer

and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to go into open session at 9:41 A.M.

Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Commissioner Roethemeyer commented that he would have to base his decision on the

information that was received.

Keri Miller of HHS again stated that her denial was based on the SSI rulings and

reported that the denial of the application would not leave her in a position that she is

unable to pay her rent or have sundries.

Commissioner Deterding questioned if she could work some additional hours to try and

help her situation.

Gwendolyn responded that she is involved in intense therapy and is not going back to

work as she was unable to handle the 6 hours a week she had been working.

Commissioner Deterding stated this is a tough decision but based on the information he

questioned what else could be done.

Motion by Deterding, seconded by Roethemeyer to accept and approve the written and

verbal findings of June and July 6, 2010 of the HHS general assistance denial of claim

by Gwendolyn Johnson. Upon roll call vote Deterding, Roethemeyer and Hewgley

voted “aye”. Nays, none.

Olivia and Bob Conrad appeared to represent MarPad LLC dba Lakehouse Bar & Grill

for a liquor license application. It is located at the inlet at Lake Maloney. The

convenience store and campground is open now and the bar will open in 3 months.

The plan is to open the restaurant in the spring of 2011.

There were no comments in opposition of the license.

Motion by Deterding, seconded by Roethemeyer to recommend approval of the

application for MarPad LLC dba Lakehouse Bar & Grill for a liquor license. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Sheriff Kramer and Chief Deputy Sparks presented an informal bid for a used ¾ ton

cargo van for prisoner transport. Several dealers had been contacted for informal bids

but only one was received. The bid received was from Joe Watts for a 2006 cargo van

with prisoner cage in the amount of $12,500.

Motion by Deterding, seconded by Roethemeyer to approve the informal bid by Joe

Watts on a ¾ ton 2006 Ford cargo van with transport cage for $12,500. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

The liquor license manager application submitted by Sutherland Reservoir Park was

continued to the July 12, 2010 meeting as the notice sent concerning the meeting time

was not received.

Kirk Nichols (Construction Project Inspector/Owners Representative) and Carol Rouw of

Treanor Architects (appearing by phone) gave the board a construction update of the

Lincoln County Jail Project.

The Lincoln County Board of Commissioners recessed at 11:00 A.M. and the Lincoln

County Board of Equalization reconvened to discuss and consider 2010 property

valuation protests.

The Lincoln County Board of Equalization adjourned at 1:45 P.M. and the Lincoln

County Board of Commissioners reconvened.

The meeting was adjourned at 1:47 P.M.

Advance notice and the agenda for the July 6, 2010 board meetings were sent to

members of the county board, county attorney and all others requesting the same.

Notice was posted at the Lincoln County Courthouse, City Hall and on the county

website.

The agenda for the meetings to be held on July 12, 2010 will be kept continually current

and open for inspection at the office of the Lincoln County Clerk. The regular meeting

of the Lincoln County Board of Commissioners will be held at the Lincoln County

Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the

Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in

the Commissioners Room at 9:15 A.M.
