Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry and County Clerk, Rebecca Rossell. Henry offered prayer. Deterding called the meeting to order at 9:04 A.M.
Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 29, 2018. Upon roll call vote Henry and Deterding voted “aye”. Nays, none. Hewgley absent.
Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Henry and Deterding voted “aye”. Nays, none. Hewgley absent.
Commissioner Hewgley arrived at 9:10 A.M.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Hewgley, seconded by Henry to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 29, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
Motion by Hewgley, seconded by Henry to approve the motor vehicle tax exemption application submitted by First Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Henry, seconded by Hewgley to approve the motor vehicle tax exemption application submitted by Great Plains Health as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
The Lincoln County Board of Equalization recessed at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.
Emergency Management Director, Brandon Myers, gave his quarterly report.
Motion by Hewgley, seconded by Henry to approve and authorize the Chairman to sign a sub grant amendment for Child Support Enforcement Services with NE Dept. of Health & Human Services. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
The following bid was received for security services for the Lincoln County Courthouse: G4S – Omaha, NE – $90,563.00 annually for one armed guard for 40 hours per week and one unarmed guard for 40 hours a week.
The County Board of Commissioners asked the security committee to review the proposal and make a recommendation to the County Board.
Discussed directing the Lincoln County Attorney to file a Complaint for injunctive relief
against Ryan Sellers regarding construction of his dwelling in Lincoln County, located in
the East half (E1/2) of Section 29, Township 12 North, Range Thirty (30), West of the
Sixth Principal Meridian (6th P.M.), Lincoln County, Nebraska, without attaining a zoning
permit from the Lincoln County Zoning Administrator, Judy Clark, as required under the
“Zoning Regulations of The county of Lincoln, Nebraska.”
Planning Director, Judy Clark, explained the legal description had the wrong legal
description on last week’s agenda so the item was put back on the agenda. She
reported that she had received a complaint concerning the new construction by
Mr. Sellers. She sent various letters on April 21, 2017, July 10, 2017 and one in
August, 2017 to the address listed on the County Assessor’s property file. She stated
that Mr. Sellers did submit an application for a permit but it was not approved as the site
plan was inadequate.
Ryan Sellers stated he did fix the issue with the corrals from the April letter, he did apply
for a permit and that the check had been cashed for the permit fee. He had done a
more detailed site plan which he handed out to the County Board and Judy Clark. He
requested that the County Board set a policy for notifying individuals about items that
would be on a public agenda. He was unaware his mailing address was not correct at
the County Assessor’s Office.
Planning Director, Judy Clark, stated that the site map that was distributed at the meeting is now sufficient.
Motion by Henry, seconded by Hewgley to declare the county’s scrap iron in the Lincoln
County Road Department to be surplus property, which is obsolete or unusable by the
County. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Henry to set the value at $110 a ton on the surplus
property (scrap iron) located at the Lincoln County Road Department. Upon roll call
vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Henry, seconded by Hewgley to approve selling the surplus property (scrap
iron) to Alter Recycling for $110 a ton contingent on the total value of the surplus
property (scrap iron) being under $2,500. Upon roll call vote Hewgley, Henry and
Deterding voted “aye”. Nays, none.
Deputy County Attorney, Joe Wright, gave an update on the Lake Maloney Hiking and Biking Trail Project, Phase 4. The County has been awarded a grant in the amount of $242,429.00. He reported there are some different steps in this grant that was not in the prior grants. The County has to do a drug program for Lincoln County Employees
as part of the grant and Administrative training is also part of this grant.
Commissioner Hewgley suggested a joint meeting of all the parties involved in the grant.
Recessed at 10:49 A.M. as the Lincoln County Board of Commissioners and
reconvened as the Lincoln County Board of Equalization.
Motion by Hewgley, seconded by Henry to go into closed session at 10:50 A.M.
concerning strategy session regarding pending litigations and to protect attorney client
privilege, which is clearly necessary to protect the public interest. Upon roll call vote
Hewgley, Henry and Deterding voted “aye”. Nays, none.
Chairman Deterding restated the motion for the closed session
Motion by Henry, seconded by Hewgley to go into open session at 11:45 A.M. Upon roll
call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Adjourned as the Lincoln County Board of Equalization at 11:46 A.M. and reconvened
as the Lincoln County Board of Commissioners.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on February 2, 2018; and was also emailed to the media on February 2, 2018.
The agenda for the meetings to be held on Monday, February 12, 2018 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
