Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and Deputy County Clerk Terry Heessel.  Deterding offered prayer.  Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners on June 11, 2018.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to receive and ordered filed the treasurer’s receipts.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to receive and ordered filed the fee reports submitted by the Lincoln County Treasurer and Lincoln County Sheriff.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to authorize Chairman to sign the contract with Western Engineering Co. Inc. for LCDOR 2018-2.  Upon roll call vote Hewgley, Henry and Deterding voted “aye’.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 11, 2018.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Julie Stenger, Lincoln County Assessor, was present.

 

Motion by Henry, seconded by Hewgley upon certificates of correction and refund as submitted by the County Assessor.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to approve the Notice of Valuation change 2018-008 to 2018-0010 as submitted by the County Assessor.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

The County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Julie Stenger stated that the purpose of the next two contracts is to extend the service of Orion/Tyler Technologies which is used by the Computer Assisted Mass Appraisal System for the County Assessor’s office six months, until December 31, 2018.

 

Motion by Hewgley, seconded by Henry to approve the agreement with the Nebraska Department of Revenue and Tyler Technologies, Inc. where by the Department will host a Computer Assisted Mass Appraisal System provided by Tyler to be used by the County for the Operation of Lincoln County Assessor’s office from July 1, 2018, through December 31, 2018.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Henry to enter into a Maintenance and Service Agreement with Tyler Technologies, Inc. regarding the Computer Assisted Mass Appraisal System from July 1, 2018 through December 31, 2018.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Carla O’Dell, Lincoln County Department of Roads, presented her findings concerning the bid/proposal on the Lake Maloney Hiking and Biking Trail Phase IV.  The references were contacted for both Baker and Associates, which were favorable, and TC Engineering which provided references with no contact information, although they have done work for Lincoln County previously.  She also contacted both entities about the construction observation for both firms, to which they responded.  Baker and Associated responded that their intent was to have at least 5 full days or the equivalent number of partial days on site.  They would be on site for any major pours, and update meetings.  TC Engineering is to be onsite for major activities including grading, paving, retaining wall construction, as well as meetings with the property owners as needed.

 

Jim States, President of the Homeowners Association at Lake Maloney, stated that TC Engineering has been involved in the previous Phases of this project.  They have talked with the home owners and are aware of issues with the terrain and the proximity of the houses to the road.  He stated that he was not contacted by Baker and Associates, and is not aware of them coming to visually inspect the properties involved.  Mr. States “feels it is worth having a local company readily available”.

 

Brent Burklund, of TC Engineering, stated that they are within the percentages allowable by the Federal Government and presented some background information on the project.

 

Hewgley commented that the County Board does understand that this is money that ultimately comes from the tax payers as Federal Funds and would need justification for accepting a higher bid.  In his opinion the “Construction Observation” is a factor.  He believes that the Board is justified in looking at the higher bid/proposal because of the time and complexity of the project.

 

Deterding also believes that the onsite time during and after construction is an important factor.

 

Brian Hope of NPPD stated that TC Engineering’s knowledge of the project and the time they have already put into it should be taken into account.

 

Henry stated that the comments presented today, has helped him to make this decision.

 

Motion by Hewgley, seconded by Henry to approve the bid/proposal from T. C. Engineering Inc. for design, construction and inspection service of Lake Maloney Hiking and Biking Trail Phase IV in the amount of $45,500.00.  Upon roll call Hewgley, Henry and Deterding voted “aye”.  Nays, none.

Advance notice and the agenda for the June 18, 2018 board meetings were sent to members of the county board, county attorney and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County Website on June 15, 2018; and was also emailed to the media on June 15, 2018.

 

The agenda for the meetings to be held on Monday, June 25, 2018 will be continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
